UPDATED: Frivolous Ethics Complaints? You Betcha!

The other day, we posted about how Governor Palin is being forced to rack up hundreds of thousands of dollars in legal bills to answer frivolous ethics complaints being filed by ankle-biters.
Today we get a clear illustration of just how frivolous these complaints are. The left-wing Alaskan blog "Celtic Diva's Blue Oasis" has breathlessly released a "bombshell" press release about the latest Watergate-level scandal overtaking the Palin administration:
Linda Kellen Biegel, better known as blogger "Celtic Diva," is filing an ethics complaint with the Attorney General today against Governor Sarah Palin. The complaint alleges a conflict of interest when Governor Palin wore specially designed snow-machine gear advertising her husband Todd's biggest Iron Dog sponsor, Arctic Cat Inc. She did so while acting in her official capacity as Governor of the State of Alaska and official starter of the Iron Dog Snow Machine Race.
Not only was she well aware that there would be extensive Alaska media coverage, the Palins also knew that international magazine Sports Illustrated was coming to do a story on Todd.
Biegel provides links to the Palins' APOC Financial Disclosure Statements for the last two years, which reveal the thousands of dollars Todd Palin receives in sponsorship benefits from Arctic Cat. While there is nothing illegal in actually receiving sponsorship money, this makes the Governor's wearing of Arctic Cat gear while representing Alaska the equivalent of a walking billboard, providing benefits to a private company from whom she and her family derive income.
Yes, that's right, folks -- because Todd Palin was sponsored by Arctic Cat, Palin is being charged with an ethics violation for wearing this jacket to show solidarity with her husband's Iron Dog team:
The actual complaint can be read here. This complaint is going to be laughed out of the Personnel Board, but the Governor will still be forced to spend some time and money defending against it. This is what we're up against, folks.

Where can one donate money to her legal fund?
This is ridiculous and it needs to be stopped. Any ideas? I wish Sarah would get Mark Levin involved. However, they would probably file another complaint about that. Interesting that these complaints are all being filed by women.
The goal is clear, destroy Gov. Palin politically, and her entire family financially.
It's time for someone up there in Alaska to start investigating these people, Elton, French, Biegel (looks more like Beagle to me), Kilkenny, Andrea. Besides Elton and French, do any of the others actually have paying jobs that would allow them to actually engage in this type of activity. Follow the money, and I'll guarantee you that it leads right back to Axelrod.

I do not understand. Do these people have to put up their own money to file these charges? When they are thrown out does the loser have to pay all the fees?
If not then the law needs to be changed. You can really destroy someone financially if it costs you nothing to bring made up charges. I would say that with a dishonest politican you could even blackmail them, get favors from them to stop your war of bringing charges against them every time they turn around.
I think the legislature, a TV station, a newspaper, someone up in Alaska needs to really start to do a story on all this. To see what is going on. How are these people coming up with the money to do this. How can we have some type of penalty if you bring charges and they are frivolous.
They have such a great gov. Why would you allow a few people to do this to her. If I were her I would be tempted to just quit, why put myself through all this.
I hate to see Palin need a legal defense fund. That makes her like Clinton, but he could not control his self. Sarah is just doing her job, being a supportive wife and a good mother and she gets hit with all these ethics complaints.

Having a "legal fund" sounds socialist to me. Sounds like palin should play by the rules and she wouldn't have anklebiter all over her azz. And calling someone fat, well sounds just like palin who laughed on a show with lynda the host were calling her fat and a cancer, and palin giggled.

I believe it is the law that ethics complaints are supposed to be confidential.
Therefore, there is definitely something more than just "citizen concern" from both Andree and Celtic when EVERY ONE of their complaints is VERY public, and is, in fact, publicized by themselves.
Can't someone sue them for all their very public, very illegal ethics complaints?
Yes, Mark Levin has emerged from his bunker to publicize his book; maybe SarahPac should grab him while they can to tackle all of this stuff. He'll make sure people know about the frivolity of it all ... And he has the legal chops to get it all dismissed!

Actually, these complaints may have some value when widely publicized. The public will get to know what kind of frivolous lawsuits that are waged against Sarah and that might blunt the impact of Troopergate.

Politicians and other prominent people set up legal funds when they have huge legal expenses. The Clintons famously had one but so do many other people who are being legally harassed or facing numerous suits/claims. It is a common thing nowadays.
It is a very smart thing to do because your supporters can give you money directed just for that purpose so it does not get commingled with other funds like those used for your campaign or other expenses. Sarah will have no problem with donations. Most Americans hate to see injustice.
Seriously, the good people of Alaska need to be made aware of the costs involved in these complaints which the taxpayers are charged for. Not to mention the valuable time wasted by the Governor and other government officials on this bs when those hours could be put to good use.
These cases are adding to the logjam in the legal system also. There is need for reform of these ethics complaint laws so they cannot be used to harass, intimidate and bankrupt a public official like the Governor.
I agree with someone who proposed that if an ethics complaint is found to be frivolous, then the loser has to pay attorney's fees and court costs. The complainant should pay mandatory upfront fees when filing like in other legal cases.
The complainant should be required to disclose whether they are being paid to file such complaint; disclose any conflicts of interest (e.g., seeking to harm the Governor/public official for political gain, using the complaint as payback, doing it for publicity, having personal animus toward the accused, etc.); demonstrate legitimate "standing" to file, etc.
If a complainant has a record of filing false or frivolous charges, they should be punished by fines/charges against them.
C4P - it looks like someone needs to contact Alaska media and politicians to bring public awareness to this problem. Maybe someone can contact the Governor's office/SarahPac with our concerns about how Alaska's ethics laws may need to be amended or clarified by the Legislature to lessen these types of abuses. As Sarah becomes more prominent as a national figure, she will be the target of more and more of these bogus claims.
This is a travesty of justice and does not serve the stated purpose of the ethics laws. Rather it undermines the entire system of ethics reform that Sarah and the legislature worked so hard on. Ethics laws should not be used for witchhunts like this. Sarah needs to get with her supporters to fix this or it will not reflect well on her.
As Sarah supporters, we could write letters to the press, including the blogosphere, about these frivolous witchhunts. Maybe Team Sarah members who read this blog can try to drum up support over there for this cause. I know there is a NewsWatch TS group that takes on the MSM lies/smears of Sarah. I have to go for now but I hope we can get something going on this.

Also, I am just thinking. If Sarah didn't become the celebrity she became after being nominated for VP, she still would have to pay legal bills for Troopergate and other nonsense cases. How would she ever have recouped money then? That's what makes these people so vicious and unforgivable.

Even though I didn't write the entry above, I will have to admint that I do love Plain...she is so terribly tragic in a lead actress in a soap opera kind of way. Just when you think all of her story lines have reached dead ends, she comes back to life entertaining us in the lower 48 with more drama.
With that said, I do believe htat she is the best thing to happen to the Democratic party in decades. Who else could have caused such an electoral landslide for Obama? Hey FW, nice try with your post. At least you're honest about being dependent on government welfare, which does more harm than good, but that's a different subject. As for your expert electoral analysis, anyone who knows anything about data would know that Sarah Palin was a net plus when she was factored in the equation. She rallied the conservative base, but was she also supposed to attract moderates and independents? What was McCain's role exactly in all this? Wasn't that his job? If she wasn't on the ticket, he would have lost by double digits.
I know it's futile trying to tell you this, but I hear this a lot and I find it laughable.

That's why I have always been of the mind that she should NOT run for re-election. Spend that two years traveling the lower 48, helping raise money for herself and other candidates, building relationships and become fluent in all of the national issues. She simply can not be a national figure on such a short lease, in a state as far away as Alaska. The unrealistic standard she is held to (by both parties) will never change.
For Gov. Palin the 'Night of the long knives' is every night and I don't want her to take that risk.
The best way to stop the filing is for the governor to follow the ethics code. Very simple.

The conclusion of all these ethics complaints has been that Sarah has done nothing wrong. These complaints have nothing to do with ethics, and everything to do with the politics of personal destruction.

I think this will ultimately benefit Governor Palin. The vast majority of Alaskans approve of the job she is doing (64%). The more these nonsensical "ethics complaints" are filed, the sillier her enemies look. I suspect the next poll will give her an even higher approval rating. Some have said earlier in this thread that it takes money to file these frivolous complaints. We should follow the money and see where it leads. If we can trace it back to Obama and the Democrats where it doubtlessly originates, that would be a tremendous gift.

I was just pointing out that I hated she has been forced to need to set up a fund. Sarah is the only high level politican whom I trust to always be totally above board.
I will gladly donate to her fund once it is set up. I think it is a terrible wrong the way she is being treated. I hate for all her hard earned money to go to wasteful things. I also hate all the stress this is probably putting on her.
I know you are right. It is a sad state of our country that anyone who is high profile, especially if you are conservative, would need a defense fund.

THIS IS A WIN FOR SARAH: Independent voters do not like petty crap like this. They will see right through it and when Sarah points it out in her book it will just be more votes for her. We should all thank these petty people for doing this. We know

In the photographs provided, the logo on the Governor's suit reads "Team Arctic" - the name of her husband's team. Clearly, that would appear to suggest that she is supporting her husband's team; not unreasonably so.
There doesn't appear to be any reference on the Governor's suit to Arctic Cat, the company which manufactured the snowmachines used by Mr Palin and his partner (and a number of other competitors in the race).
LMAO anyone who thinks this is a legitimate ethics violation needs some serious medical help.

Lately, people have been coming on here just to leave some nasty, snarky comment and leave. This is not the Huffington Post, or the Daily Kos. I believe in discussion, not name-calling. But I feel a response is necessary if someone crosses a line.
If these were legitimate complaints, I would give them more attention. But simply wearing the jacket of her husband's sponsor? Please. Barack Obama got a sweet heart deal for his home in Hyde Park from a convicted lobbyist and no one talks about it. I'm from Chicago and I know all about it.
Already 6 of the 10 complaints have already been thrown out. And yes, I do realize that she will need more support than just her state to wage a national campaign. That's what this site is about. Maybe you dislike her, but there are a lot of people out there who like her including me.

With all due respect for your opinions about Governor Palin, you should realize that there is substance to the ethics complaints against her. She has a very hard time separating the personal from the professional, and it's been getting her in trouble for some time now.
If you truly cared about her future, you would find a way to encourage her to "get smart" about ethics.
If you want her to become a serious national political figure, you would stop sweeping her misconduct, her ethical lapses, and her refusal to take responsibility for her actions under some massive "I love Sarah" rug.
Your numbers, especially in the "lower 48" are not large enough to carry her, warts and baggage and all, through a national campaign and then a successful election.
Isolating yourselves, cutting off those with whom you disagree politically, ridiculing people who happen to be independents and moderates, and playing victim (something Sarah is very good at) is not going to help you build a following of the size you'd need to carry Sarah to the White House.

This ethics complaint should not be filed. All this is a Democrat playing politics. My problem is that Alaska law makes it to easy to file ethics compalints against the Governor. What she didn't SEE is that it's her responsibility to pay to have her children with her, not the state's. And so she settled, paying back $9,000.
That's the same reasoning Sarah used when she had Todd and her staff harass the public safety folks about doing something more to Wooten, like fire him. "That's something any citizen would do," she said. What she didn't SEE is that ordinary citizens aren't married to their state's Governor, and ordinary citizens don't get to use the Governor's conference room, phones, and access to staff.
Any of us might pump up our spouse's team, but we are not acting in an official capacity. If you or I were at Iron Dog wearing Arctic Cat gear (btw, Team Arctic is a trademark of Arctic Cat, it is NOT the name of Todd Palin's team 22) I doubt Greta Van Susteren would have been there to interview us. People Magazine wouldn't have been there to interview us in those jackets.
To be ethical, to know right from wrong, to avoid conflicts of interest, you have to think about these things. It may be a good start to imagine how you'd feel if a similar complaint was raised about someone of the opposing political party, for example... ;)

That is time and cost that can be saved for those complaints that are legitimate. A good idea from Sarah Palin Rocks, what is the reason this person is filing a compliant. A great idea for filers to pay upfront and pay the costs when they loose. And to make sure those filing complaints, keep it confidential or they will be fined for going public with it while it is being reviewed.

This isn't so much about the fact that she wore the coat, or that the state paid for her to travel there. It is about the fact that she wore the coat while performing official state duties, like starting the race. While doing that, she was not just supporting her husband's team, she was acting as the governor of the state. By wearing the jacket, which was supplied specifically for her (personalized) by a company that sponsors (gives $/discounts/merchandise) to her husband and his team, it is a blatant conflict of interest, as well as violating the ethics code mentioned in the complaint. It's that simple. Had she worn a different coat while starting the race and when performing other official duties, there would be no issue. Silly? Maybe, but this is coming from a woman who said she wanted a transparent government. It actually surprises me that none of her staff would have thought of this ahead of time- it's not something that someone has to think too hard to notice.

Ennealogic, the council voted ONLY to release the report, but they did not VOTE to confirm the report, i.e., to find an ethics violation THEMselves. They didn't call it to a vote because they didn't HAVE the votes. A panel of attorneys on CNN (of all places) reviewed the Branchflower report after it was released and said the logic was "convoluted" at best to find a violation. Petalumous said Branchflower flat out misinterpreted the law, so even lawyers disagree--even if she failed to rein in her husband, the lawyers on CNN opined that it did not rise to the level of an ethics violation under AK law.
The members of the personnel board were all appointed by previous governors. Palin did re-appoint one who has been a long-time member under several governors.
It's really pathetic that some people are willing to reduce themselves to a petty, dishonest, and cruel being in order to hurt an honest and upright leader like Sarah Palin. In your quest of destruction, you have destroyed your quest for truth.

Education is NOT a money issue. The problem is not money. We spend all over the country a tremendous amount of money per pupil in the public and college systems.
The problem is no accountability and no choice. I get all the facts from my father who is a retired public school teacher.
This grab for that money is nothing but people wanting something for nothing. Rampant greed just like AIG and the banks and the goons in the House and Senate that made it all possible.
Freedom to choose your children's school would really do so much to lend accountability AND with the leftover increase per pupil spending for special needs kids.

A lot of people have been frustrated with many of Palin's actions. She seems to be constantly putting her own interests ahead of the state's. She is so ready to appoint friends with limited qualifications to positions and not appoint anyone who ever disagreed with her. Turning her back on the rural people until a good photo-op came along, refusing the stimulus money for education, and not doing the heavy work on the pipeline proposals are all things that have frustrated Alaskan voters. When people are frustrated they often do whatever they can to get noticed and listened to.
Thus we get into big hassles on small points. Encourage the governor to pay more attention to the people of her state and less to her Potomac fever.

To R.A.Mansour: Kim Elton's base salary is 1/5th Gov. Palin's and he grossed less than $45,000 altogether including salary AND per-diems last year (for a 90-day session and four 30-day sessions, two of which he evidently waived). I'm amazed you C4Pers and Adam Brickley are all up in arms over that.

Really, that's not good, as a measure of popular support for Sarah Palin. Statewide her support is closer to 43% (you have to think the western villagers aren't too keen on her) b/c her support is mainly in the Anchorage/Valley/Fairbanks "civilization" areas, less than half the entire population.
I think the story that there is polling being done re: Sarah Palin and whether it would impact how voters in the lower 48 would view her as a prospective POTUS if she did not run for re-election has impacted C4P and caused the trolls to appear on orders from Axelrod.
Obama knows that once Sarah leaves Alaska (decides not to run for re-election) he cannot use the state of the Alaskan economy as a major issue in the 2012 Presidential election and that Sarah will no longer be impacted by anklebiters.
The time to crucify Sarah is between now and Spring 2010; Obama knows he failed in 2008 to take her out; she proved more resilient than even Axelrod thought. This time they have vowed not to fail. Short of murder the Messiah, his merry men and women, the MSM and the nutroots mean to destroy Sarah. You betcha!

Actually, Sapwolf is right. Money is not the problem. Kids need good teachers, teachers not protected by powerful teachers unions. Advancement should be based on merit and results, not duration. School vouchers give students the ability to attend charter or private schools, and makes pubilc schools compete. The other issue is many of these kids from the inner city come from single parent households. This percentage is increasing across the board from families of all races and needs to be adddressed. Success is largely dependent on two parent households.
Lastly, Sarah's daughter is graduating from high school. As did her older son Track.

Great idea about Sarah filing a lawsuit against Obama's pathetic bottom feeding agents in Alaska. I do wish she would proceed with alacrity in establishing that legal defense fund and get the word out to Rush, Glenn Beck, Hannity, Levin, and whoever else. In addition to suing them, another route her legal defense team should persue is the money trail. Who is financing these moron's lawsuits? If a clear connection back to Obama and/or the DNC can be established, their Messiah will be finished.
In the liberal worldview assertions are the truth, everything else is hateful opposition to the agenda. All those who oppose the agenda are evil. There are no facts other than what proves the assertion, all else is misinterpreted or irrelevant data. The agenda determines the assertion, the assertion is the truth and only the relevant facts support the assertion. Anyone who attempts to subvert the truth of the assertion is evil and their minds are full of hate. Thus forms the perfect circle of liberal thought, the agenda, the truth and the relevant facts. If you are a lawyer reading this, you know why the American system of law has nothing to do with justice, the perfect circle is drawn by the line of argument.
Just one more reason why we need to adopt a "loser pays" law.

Off topic I know. I just flipped through the TV and caught about 15 seconds of The Messiah's news conference. In it he said something about how he wasn't worried about the enormous deficits his budget will cause because he "recently convened a fiscal responsibility conference". I laughed so hard I could hardly breathe. This is the guy who just increased the deficit more over the next four years than all previous presidents combined from George Washington through George W Bush. Unfortunately, due to my uncontrollable laughter, I didn't catch whether or not the estimable MSM reporter who asked him the question called him out on this hypocrisy. I'm guessing not.
I see the trolls on here are concerned with the really momentus matters such as which coat Governor Palin wore a few weeks ago. Gotta have your priorities in the right place I guess...

The very fact that she put this press release out means she wants the news media to report on it...I think this move tells us that she sees highlighting this complaint as an advantage to her because the media didn't pick up on it.

I totally agree with you as to why she put out a press statement. She wants this ridiculous charge to get as much air time as possible. This type of nonsense will only help her by expoing her enemies for what they are.
I am used to reading and not commenting but I do want to say that keeping the rhetoric cooler helps people make sense of all this. I know the latest ethics complaint seems frivolous and maddening. Governor Palin is a wife who was supporting her husband's endeavors. The problem is she is not only a wife, she is an office-holder who is bound by ethics rules. And the problem wasn't that she was wearing a brand name, but that she was wearing the brand name of the company that paid her family for publicity. I know it seems like a fine line, but it is a line, unfortunately. There must be constructive things to do about this rather than dismissing it. Contributing to a legal defense fund for Governor Palin would help her in case this issue gains traction.
R.A., I think if Michelle got sick of trolls or foul-mouthed folks, that simple system she had was enough to block said posters when their info came through.

I'm a bit torn as to whether Palin should respond verbally to clearly frivolous ethics complaints. On the one hand, I feel she should not dignify this garbage, just let her attys deal with it, and raise the money with a legal defense fund. In a way, it makes it seem as if these jokers are winning b/c this nonsense is clearly getting to Palin. Maybe she should stay above it all, and let her surrogates do the fighting for her.
On the other hand, something unquestionably stinks. Maybe I'm wrong, but this doesn't seem to be a typical case of a politician scrapping with his or her enemies. This is an orchestrated and transparent effort designed to cause personal ruin, not merely to get her out of office. If she calls attention to it, Alaskans might rally around her.
I'm not sure what I would do if I were in her shoes. However, I hope she knows a lot of people there and in the lower 48 have her back.

I understand Erich's point that responding to these frivolous charges may not be the best idea. However, this is the most frivolous yet and I think in this case responding to it makes sense, as TommyReport notes. Making something this silly public will help Sarah and will not inure to the benefit of the pathetic individual making the charge.

We just get pissed when silly sh!t like this goes on. If I may we know Gov. Palin has alot of supportes in AK. 64% tells us that much. The only political activite that matters is the vote and may I say thank you for givin us inthe lower 48 Gov. Palin
