Andree McLeod’s Ethics Complaint Against Palin Bites the Dust! UPDATE: Thomas Van Flein on the Eddie Burke Show



The Associated Press reports:

ANCHORAGE, Alaska (AP) - An independent counsel has advised dismissing a complaint against Gov. Sarah Palin that claims she violated the state ethics law.

In her complaint, Andree McLeod asserted that Palin violated the Executive Branch Ethics Act in two ways.

The Anchorage woman, who has filed numerous ethics complaints against the governor, points to a press release from the governor's office announcing that John McCain had selected her to be his vice presidential running mate. The other involved Palin's participation at a National Republic Congressional Committee dinner.

Michael Geraghty of DeLisio Moran Geraghty & Zobel, P.C., says neither case constitutes a violation of the state ethics act.

We'll post the Geraghty decision as soon as we get a copy of it. Consider this a developing story....

In the meantime, donate to the Alaska Fund Trust to help the governor pay for the legal bills she racked up to defend herself against this stupid complaint.

Another McLeod Ethics Complaint Fails

May 27, 2009, Anchorage, Alaska - Governor Sarah Palin today welcomed the news that yet another ethics complaint against her has been officially found to lack merit and has been dismissed.

Michael Geraghty, investigator for the State Personnel Board, concluded that there is no need for a hearing on the complaint filed in March by Andree McLeod, who has been a vocal critic of the governor since being denied employment with the state last year.

This is the 13th ethics complaint against the governor or her staff that has been resolved with no finding of a violation of the executive ethics act. A few more are pending.

“While the complaint process under the ethics act can be a useful tool for holding state officials accountable, it’s obvious that political opponents of the governor have been abusing the system, attempting to turn their resentments into legal issues,” said Bill McAllister, the governor’s communications director. “We’re grateful that the personnel board and its investigators have taken a rational approach to these matters, finding that the vast majority of the complaints did not even warrant the collection of evidence because they failed to assert any violation of the law.”

McLeod’s complaint, amended several times since it was first filed, made eight separate allegations against the governor. McLeod said that there were two matters showing an improper connection between the governor’s office and her political action committee; that two comments made by McAllister about the governor’s travel plans were political in nature; that the governor’s trip to Evansville, Indiana, for a right to life event used state resources, and that she improperly accepted gifts there, including chocolate, baked goods and a hockey stick from a youth hockey group; that the governor’s daughter, Bristol, used state resources in her efforts on behalf of the Candies Foundation; and that the governor’s press release concerning her selection as a vice presidential candidate was improper. Geraghty found all of the allegations to be baseless and not worthy of an investigation.

Thanks, Rebecca! I posted my thoughts re "Twitter Grammar" on that thread (if anyone is interested). Word order, in English, Latin, Greek, or in any tongue, is a subject of endless fascination. Wow, "Mae Day" helped to generate a huge number of responses on that other thread. I guess we can only pray for people like that. Her remarks are the kind I would expect from people here in Berkeley, when they see my Sarah button. And yet, as I have noted in several other posts, I have actually received some quiet compliments...yes, in BLUE Berkeley!! Maybe the fact that I am a pretty big guy, and the fact that I often wear my black leather jacket, discourages negative remarks!! :-)

Anyway, my brother is holding on, though he suffered a rather alarming seizure (?) last night. I am off soon to visit him.

We are still praying/hoping for a miracle. God bless you, dear friends, for your kindness, thoughts, and prayers!! This site has been a true consolation during these bleak months, politically and personally, for me.

Yes, it was the State Personnel Board meeting. C. Diva told them the board would be going into executive session and then they probably would have an opportunity to speak about any decisions that were made. I would think this is where the decisions on the ethics complaints were decided. The meeting was to start at 12:00.

No...I do not know the names of anyone. I read C.Diva's website this morning and it was like a call to arms..(kinda). She was just stating that the meeting was today and I guess they had pre-planned to attend in mass and some might want to make comments after the announcement from the Personnel Board.

I would love to know if there were comments made and what they were.
I would assume there will be minutes posted after the meeting maybe tomorrow or later in the week.

Palin would not need donations to a "Defense fund" if she didn't hire an attorney instead of using the Attorney General.
The benefit to Palin is that her attorney holds this state business as 'privileged', and he spins it for her.
I think Von Flein is stirring up the pot about the ethics complaints.
They are not charges, they are not indictments. No judges are involved, no juries, no criminal penalties and no courtroom.

These are administrative procedures that take place all the time. Palin and other employees ask if a past action, or a future action presents a conflict of interest, and the board has a process to determine the answer.
No problem.

When a citizen asks the same question, people freak out and runaround like their hair is on fire.

A better play would have been to act confident in her self, and not involve a defense fund and just let it play out.

She's created the impression of one who is not self confident, and has something to hide, something that takes a half million dollars to clean up. Why does it take such substantial funds to respond to something 'Frivolous?'

Playing the victim isn't very presidential, and yes I do hear a "Perceived whine."

I just read the entire review of McLeod's complaint which RAM linked to. It almost sounds like Geraghty is getting annoyed by having to look into all of McLeod's BS even though I'm sure his law firm is benefitting by all the taxpayer money thrown their way, necessitated by these ridiculous "ethics" charges. He even mentions that McLeod is a "repeat complainent". Her whole complaint is amazingly amateurish. One of her follow-up complaints was, according to Geraghty, simply an email with a link to a CNN article. Amazing!

I see Dr. Chill has again arrived with his usual advice for the governor to not seek counsel. The Governor, to her credit, is not taking Chill's ill-advised advice.

If you are going to make a complaint that forces the state to hire a high priced lawyer, and spent state time and resources to address her complaint, the least she could do is to write a well thought out argument.

Not just include a link to a CNN story with no other explanation attached to it. (I am referring to the Addendum II of the complaint).

The governor has been complaining about how expensive it is, and has been asking for donations.
Her attorney has not been completely honest about the complaints. The governor had to return some of the per diem money. There's usually a 2x penalty for that kind of mistake.
Her lawyer keeps saying the complaints are all frivolous.

If that were true it would not take 1/2 million dollars to respond to them, and she would not have had to return (2x?) the money.

A private lawyer works in the interest of the client, while the atty general, who normally would do the work, works for the interests of the state.
Why do I care?
I'm just trying to figure out who is getting over on whom.
