Two More Ethics Complaints Dismissed! Van Flein on Eddie Burke Show to Discuss
Gov. Palin's attorney, Thomas Van Flein, was on the Eddie Burke show this afternoon to discuss the dismissal of the latest two frivolous ethics complaints.

Two More Ethics Complaints Against Governor Palin Dismissed
May 12, 2009, Anchorage, Alaska – Today the governor’s office was informed that yet two more ethics complaints filed against Governor Palin have been dismissed, part of the mounting evidence that accusations of wrongdoing by the governor lack merit and have been politically or personally motivated.
The complaints, one by Zane Henning of Wasilla, filed on November 13, and one by Anthony Martin of Talkeetna, filed on December 2, were dismissed by Michael Geraghty, an investigator for the State Personnel Board. Geraghty concluded “that the conduct asserted, if true, would not constitute violation of the ethics act.”
“These are the 10th and 11th actions taken on behalf of the Personnel Board that favorably resolve complaints against the governor or her staff, and to date there has not been any violation of the law substantiated,” said Thomas Van Flein, the governor’s attorney. “There are a few more complaints pending, and then we hope this abuse of the Executive Ethics Act will cease.”
Henning alleged that the governor used her official position and office for partisan political purposes because she conducted interviews with reporters in the Atwood Building in Anchorage on November 7, 2008, and again on November 10, during which the recent vice presidential campaign was discussed. After what he called an “exhaustive review” of the ensuing news reports, Geraghty concluded: “There was no indication that Governor Palin presented her official position as governor of the State of Alaska for an improper personal or financial purpose.”
Martin alleged that the governor and aide Kris Perry violated the ethics act during a trip to Georgia in which the governor campaigned for Senator Saxby Chambliss. Geraghty concluded: “The (ethics) act does not prohibit a public official from engaging in political pursuits independent of their position as a public officer, and the campaign efforts undertaken by Governor Palin are not prohibited by the act.”
Regarding Perry, Geraghty wrote: “To constitute a violation of the ethics act, the facts alleged would have to support a finding that Governor Palin coerced Perry to benefit her own personal and/or financial interests. The Martin complaint does not allege facts suggesting coercive conduct by Governor Palin.”
“Not one of the complaints actually reached the personnel board for its formal adjudication,” noted Bill McAllister, the governor’s communications director. “Rather the complaints have fallen short based on just a simple review of the facts and the law.” McAllister also responded to comments by critics of the governor who allege that the personnel board process is flawed because the members are appointed by the governor.
“This is an illogical argument: Why file a complaint with a board that you think is biased in favor of the person you’re targeting?” McAllister said. “But the fact of the matter is that all three members of the personnel board originally were appointed by the previous governor, and they could not be removed by Governor Palin except for actual wrongdoing. The governor’s opponents are just frustrated because they are batting .000 in their attempts to show a violation of the ethics act.”

Van Flein also discussed Gov. Palin's recent book deal with Eddie and noted that it has already been approved by a Department of Law ruling. The book deal fully complies with the Ethics Act. (Note to ankle-biters: no use lodging any complaints on this one. They will be summarily dismissed.)
While we celebrate today's victories, we shouldn't forget how much trouble all of these frivolous complaints have caused the governor and her family.

These ethic complaints were fully publicized when they were filed. Now that they have been dismissed, it needs to be put out there.
I thought it was really sad on the Bob and Mark video to hear that the Guv can't even go to a restaurant to eat because the ankle biters will think that she has an ulterior motive for eating at the restaurant.
That just really hurts me to know how restrictive life has become for her. Little every day things she can't do.
I hope she finds some joy in these good days she has had lately.

The Department of Law has already issued a ruling that the book deal full complies with the executive ethics act. Any ethics complaint will be dismissed because it has all been reviewed. Beyond that, I don't care how much money she makes, she still shouldn't have to pay to be governor.

I'd bet my balance sheet Meghan was the leak of those ridiculous rumors in the campaign. It is getting obvious that it had to be her.
I am thrilled about this book deal for a number of reasons! This will give Sarah a chance to let the public find out who she is. She will have an opportunity to show off her writing skills.
Looks like Sarah is making her moves in a smart way!
I just hope that Sarah restrains herself while writing the part regarding the campaign (Meghan et al) She can save all the juicey stuff for her book after her second term ends in 2020.
Sarah is a class act so I feel confident she will.

Congrats. That's good news. These ethic charges are all a bunch of crap. They are definitely politically motivated. They are a waste of time, money, etc. Gov. Palin shouldn't have to bother with these. She's got more important things to do, like running Alaska.
The Palin's have been through a lot. I sometimes wonder if God isn't toughing up Sarah for a huge battle to come...
I'm glad the complaints are getting dismissed, I'm glad she set up the fund so we could help her and her family and I'm glad that she is writing the book. I will happily support her in wehatever she does...
If Sarah is doing something legal and that she is entitled to do then she should do it... otherwise she will be handicapped not only now but in whatever future positions she holds...she should not let people with dishonest motives keep her from doing what she would normally do...she should not give them that much power over her life... I know that's a lot of should's and my goodness the Gov sure gets a lot of advice lol...but anyway just my thoughts...

Palin has objected to this portion of the stimulus program because she believes it will require a statewide energy code, taking away local control.
But the governor of Missouri, Jeremiah W. Nixon, has succeeded in convincing the Energy Department to be more flexible.
In a letter, he wrote, "The state is committed to working with communities, to create model energy efficiency standards that, if local units of government choose to implement, should reduce energy costs for Missourians."
"The department has said we'll go ahead and allow for flexibility, the maximum level of flexibility," Sen. Lesil McGuire, R-Anchorage, said. "So we think this gives the governor now the answers to the questions she posed last week and will allow her in good conscience to accept that energy money."
Money that is Alaska's for the taking, so long as the state does not officially refuse the funds.
Palin's staff is planning to brief her Wednesday on how Missouri's governor approached the stimulus.
She has another deadline to deal with -- May 25 is the deadline for signing the bill that appropriates the stimulus funds.
She could choose not to veto the energy funds, and then the state could go ahead and apply for it even though it's past the deadline.
Who knew that May 12th would really be known here on C4P as the day Wise did battle with Uppy, hahaha. Now kiss and make up....

Has it been confirmed that the feds will not require a state wide energy code? It seems like the federal govt can change its mind at any point.
According to Lamb, there should be a horde of Alaskans standing up to support the refusal of the money right? Nothing.

I'm just baffled at this point....so it appears that no statewide code is required. Perhaps Palin just doesn't want to make the pledge because a pledge is still required from the state that it will reach 90%. Who knows?

I have no idea what this means, except that the feds can do whatever they want, and change their mind whenever they want. This whole thing is confusing, and I have no idea what she should do.

However, my suspicion though is that she won't win anyone back if she does take the money...Berkowitz and co. will still hit her for even contemplating refusing the money. Those who developed an unfavorable opinion of her because of the stimulus decision will probably not change their opinion.
She's in a tough spot and it just knaws me that Moore and company will be crowing that her poll numbers pushed her into backtracking.
At least the conservative 'sphere won't make a big deal of it since they didn't acknowledge her rejection in the first place...

I think people failed to realize that the fight over the stimulus money ended when Obama signed the bill. All the money will be spent.

So much for the theory that earlier complaints had merit because they weren't dismissed right away...remember they were pushing that meme last week because the complaint that was dismissed last week was one of the more recent ones, leading to their speculation that since the earlier ones had not been dismissed, that they merit.

She can say still voice her disagreement with the concept of the stimulus. She's on record of being against the whole thing as a means to create private sector jobs. None of this changes that. The last complaint is officialy McLeods, but I think most of the complaints orginated with her. Now they're going to be busy with the book.
I'm really looking forward to the book...the timing is interesting for Spring of 2010. I don't know what this means for re-election or a potential presidential run. She's certainly keeping things close to the vest...

I can't wait for the book. The writing process will really give her some time to reflect on where she's been and where she's going. I think this will really help her in the future. Also, I hope people don't freak out again over the energy money.
I'm psyched for the book...I think the critics will be forced to give this book acclaim. She'll do a great job.
Hopefully, she can build off themes that she develops in the book into a presidential run if she wishes to pursue one. Obama was able to with the title of his second book and with themes from his first one, if Ayers didn't write it.
"Take a Stand" is a winner for a title in my opinion. All people remember is the title...it's key.

I wonder if Gov. Palin's lawyer going on the radio twice in the last few days to discuss these bogus "ethics" complaints has anything to do with the fact that Alaska Fund Trust has generated enough money so far to pay off most, if not all, of the legal bill. He was sure nowhere around before last week.
