Celtic Diva's Bogus "Arctic Cat" Ethics Complaint Has Been Dismissed; UPDATE: Thomas Van Flein on the Eddie Burke Show

Ethics Complaint on Governor’s Apparel Dismissed

June 3, 2009, Anchorage, Alaska - Governor Sarah Palin today welcomed news that another ethics complaint has been dismissed. This is the 14th ethics complaint filed against the governor or her staff that has been resolved with no finding of a violation of the Executive Branch Ethics Act. Those complaints contain 22 separate allegations, all of which have been found to be without merit.

The complaint, filed by Linda Kellen Biegel, a blogger designated by the 2008 Democratic National Convention to represent Alaska bloggers, alleged that the governor violated the ethics act when she acted as the official starter of the Iron Dog snow machine race in February while wearing a jacket with the name Team Arctic, a logo of the Arctic Cat Company. The complaint accused the governor of using her position and state resources to serve her personal financial interests. The complaint also alleged that the governor used state resources to promote a personal interest.

Thomas Daniel, the independent investigator for the State Personnel Board, concluded there is no evidence establishing probable cause to believe that Governor Palin used her position for personal gain by wearing a Team Arctic jacket at the start and finish of the 2009 Iron Dog race.

“My investigation has uncovered no evidence that the governor or her husband received anything of value in exchange for the governor wearing the Team Arctic jacket when she acted as the official starter of the 2009 Iron Dog,” Daniel wrote in the report dismissing Kellen Biegel’s complaint.

Daniel went on to write, “I also note that most jackets worn by Alaskans have a company name or logo on them. It is common to see jackets with logos of North Face, Patagonia, Eddie Bauer, Marmot, Cabella’s, L.L. Bean and others. Indeed, it is more likely than not that any jacket that an Alaskan wears will have a company logo on it. So the fact that a person wears a jacket with a company logo on it is not evidence that the person is receiving a financial benefit as a result. To the contrary, it is the company that is receiving the benefit in the form of free advertising.”

"This complaint cost the governor personally, and the State of Alaska, thousands of dollars to address,” said Thomas Van Flein, the governor’s attorney. “It is regrettable that the ethics process has been diverted for partisan purposes by some, but it is also commendable that the board remains focused on the law."

UPDATE II by RAM: This is rich. The denizens of Mudzilla’s Dirt Central are claiming that the governor lied in her tweet about it being cold on the days she wore the Arctic Cat jacket (at the start and finish of the race).

The high temperature in Big Lake on February 8, 2009 for the start of the Iron Dog was 9.4 degrees Fahrenheit.

The high temperature in Fairbanks on February 14, 2009 for the finish of the Iron Dog was 22 degrees Fahrenheit.

Sounds like balmy weather to me!

All these charges being thrown out one behind the other. The public is finally being vocal about being fed up with paying for these people filing these bogus complaints, AGIA is moving forward and she is hitting lots of home runs with her press releases, plus her upcoming East Coast trip.

If this dismissal is simply based on independent scrutiny by independent legal experts it may not have a leg to stand on once Judge Andree is asked to review it on appeal.

I hope that she references three or four times in her press release that Celtic Diva was the DNC's Official Alaska blogger. Hopefully, the media will pick up on this when they report the story.

around him, and as a result the nation has cought its breath, at least for a while, about what's important. The Arctic Cat complaint was never about the jacket, but the fact that she wore while denouncing the stimulus, even taunted Obama to veto it, and start over.That's another whole order of blasphemy in the liberal hymnal.

That is a little bit of an error, Rusty. She said Democrat blogger, not DemocratIC. Seems small, I know, but it matters somewhat.

The Democrats started whining a couple of years ago that they did not like being referred to as the Democrat Party, that henceforth they would be called the Democratic Party.
This is more Orwellian language manipulation.
I refuse to play that game.

The ADN is really so transparent it's laughable.

If you go to their website frontpage now, there's an article about the "sniping" politicians over Palin's AGIA.

And then there's a sweetness and love sympathy, bi-partisan puff piece on Daughter Murkowski's knee injury bringing peace and joy to the land of DC.

So one public servant is doing a hard job, making the tough decisions, and getting flack for it, while another one hurts her knee while skiing (Does anyone know when the good gov has last taken a vacation?), and brings the spirit of goodwill to the land.

ADN you are a laughable disgrace. If AK weren't so Republican, you'd really have to change your name to the Anchorage Democrat News.

Really, who cares about Michael Reagan. He is only a marginal "talker" right now. His ratings and number of stations caring him have gone downhill for many years - and he is rarely on TV as a "talking head". His writings don't get much circulation either. As long as Sarah has Rush, Laura, Levin and Beck on her side - who cares about Michael Reagan.

Two things are making Sarah very happy these days:

1) Ethics complaints going down.
2) Oil prices going up.

Eddie Burke on his twitter said he had dinner with Michael Reagan and Mike Hawker last night and asked Hawker if he was going to vote to override Sarah's veto. According to Eddie "Hawker got real pissed when I asked him why he wanted to spend more money" Gotta love Eddie putting these RINOs' feet to the fire.

Chris Chizilla (sp?) has a "washington whispers" article up on the Washington Post arguing that Sarah should NOT run for reelection. Same arguments we have been having here for months but his arguments were pretty superficial. He should read C4P to get a more sophisticated analysis.

I'm glad for her -- this was the only complaint that I had even a slight bit of concern about, given how the ethics law was written.

I'm still sending her chunks of cash until I hit $300, though ($150for myself and $150 for my wife). I also still wish she'd raise the limits on the Fund. BTW, any updates on how that is doing?

OT, Report out of Auburn says that the $250 tickets to meet and have a picture taken with Gov. Palin are sold out, some $100 tickets are still available. She will also be taking part in the actual parade. It says her public remarks will be brief, too bad. Let's hope for a huge crowd, and some Palin 2012 signs along the parade route.

It's funny how Republicans are being told to softpedal their candor with Sotomayor for fear of reprisals? That's going to make them fearful of asking pointed questions for fear of retaliation at the ballot box. So how come it's okay for the Democrat party to harass a citizen using a third party blogger to do the dirty work? How is it that nobody has bothered to actively countersue and demand documentation on who is paying them, who arranged for payment and who is getting benefits from this legal barrage? In short, how come Democrats aren't afraid of the reprisal against them by conservatives who see Palin as someone who is being deliberately dragged through the mud by Moveon.org, Soros and whatever other political outlets are tapping this story? This needs wider coverage.

The press releases from the governor's office are not accurate.

Not finding guilt, and not finding evidence is not the same as finding the complaints are without merit, and finding that there is no evidence.

I've come to think that the dismissal doesn't mean much.
The per deim complaint was 'dismissed' without a finding of an ethics violation, so why'd she return the money?

I'm surprised Thomas Daniel pretended not to know about the Palin's contract to promote Arctic Cat, but totally stunned that no one is calling it frivolous.

Consider this. If this were a democratic governor that had 14 ethics complaints filed and dismissed – you know the MSM would be all over the story especially if a blogger designated by the Republican National Convention was the driving force behind the complaints.

This is huge and you know it. Identifying Biegle as a democrat operative hurts the Democrat Party.

Diva didn't just lose this one, she dragged the DNC down to this level.

Not only did the Diva lose, but so has the DNC.

This complaint should have never been filed by her. She goes down, so does the reputation of the DNC.

This looks purely political and has nothing to do with ethics in the state of Alaska.

She did this while she was asking for donations to the PAC, as an anonymous blogger. She took her name off the form, but left Linda Biegle's on (yes, that Celtic Diva), and her husband. Wonder why she took her name off? Maybe she thought she might get caught in doing something unethical?

Yes. Todd is under contract and paid to promote Arctic Cat.

Daniels concluded that it was 'conjectural' to believe that Arctic Cat would return the favor, when Sarah Palin ( the governor people talk about what she's wearing something... ) came out wearing their jacket.

Regular citizens generally are not held to the ethics standards set out in the Alaskan executive branch ethics law.

As governor, and someone who came to power under the banner of ethics and 'hold me accountable', should IMO not even approach anything that looks like an ethics violation.

Anonymous bloggers generally are not Alaskan state executive employees, and do not have the same conflict of interest issues.

WRT the PAC, what ethics problem ?
Having an anonymous blog?

She has been ambushed by partisan attacks in the form of frivolous complaints. She did nothing wrong.

How do you propose she avoid even approaching "anything that looks like an ethics violation" when she is being charged with things like having her press secretary respond to a question about her attendance at an event? Why should she "avoid" supporting her husband in a race that he has participated in for years before she was ever a governor? Is she not allowed to be a wife?

You are in the wrong. The law supports Palin's position, not yours.

It's actually quite useless discussing these things with you because you are beyond reason.

Also how can anyone say that the complaint was not completely vetted after reading what all the investigator did to prove or disprove the complaint... but we all know they will write what they want to write true or not true...

The justifications for these complaints are so weak and lame that it would be hilarious if it did not cost the taxpayers, and the Palin family so much money to deal with it.

It is so obvious they just want to attack Sarah's government reform record, which is excellent.
It's an old political tactic, undermine your enemy's strength and make it a weakness.

This effort has blown up in their faces like a cheap M-80.

You don't know if she did nothing wrong.

Avoiding the line:
You can't forsee everything. But some things are forseeable.

If the governor wanted to support Todd she could have chosen something with 'Todd' on it.

She promoted Arctic Cat. Her husband is paid to do that.

She's not supposed to have outside employment of any kind.
Thats what the AK state training power point says.

Palin glasses caused the factory to go into extra shifts. She had to know people are paying attention to what she wears. (Like it or not.)

This case was not thrown out because it was "frivolous'. It had to do with Palins Intentions.

If thats the only thing between being guilty or not, then don't do it.

OR- when contributing to the collection plate, don't take money, even if you're making change...

Taking money from the collection plate when people are watching looks dodgy.

Maybe thats it in a nutshell. Just ask how would this look?

It looked like Palin was promoting Arctic Cat. Todd gets paid for that. She's not supposed to be engaged in Todds business. It doesn't look right.

Because Todd was on Team Arctic Cat, and Sarah is a national figure now, she was promoting the entire Iron Dog race and the State of Alaska as well?
There was surely more interest in that race this past year than ever before.
Do you think that was a good thing?
Would you have preferred that Greta Van Susteren was not there to bring it to us in the lower 48 on the FOX News Channel?

Like Sarah or not, you have to admit that she has been terrific in telling the rest of the country about her beloved home state. I know I want to come and pay a visit someday, mainly because of Sarah Palin.

And how would raising money for a PAC benefit her? Whats wrong with raising money for a PAC?
I just don't see what the alleged violation is.

PACs are well regulated, and you can get public records. Go for it.

She WAS the treasurer for about a week when it first started. Then she must have gotten spooked because she took her name off. Her husband is the main guy.

While I don't think Dr.Chill is CD I'm beginning to think he is almost as "disturbed" as she is. The level of obsession people like that have with nitpicking Gov Palin for things that do not affect them whatsoever is rather strange. One might wonder if they are the ones that have a religious complex about Palin. They seem to think they own her and that by being elected governor she somehow gave them total control of her life.

And to take the time to spread that faux concern on a msgbd openly identifying itself as a "pro-Palin" site indicates someone who has too much time on their hands or someone whose main purpose in life is to be an ass.

There are two obvious points:

1) The main reason the Guv wore the coat is because it was cold outside. I wear a coat when it's cold. It's a smart thing to do.

2) The coat doesn't even say "Arctic Cat" but "Team Arctic".

Now it would make no difference to me if it said Arctic Cat, but "Team Arctic" seems far more supportive of Todd and his team than the company itself. The complainers would have you believe that when people saw Sarah with the Team Artic jacket thousands of people in US snowbelt rushed to their local Arctic Cat dealer and plunked down $10,000 + for a new Arctic Cat snowmobile. (If only...) Furthermore, that Arctic Cat stock went through the roof. (I'll have to check, but I think Arctic is a privately held company, and not a publicly traded stock).

I would think that neither of the above happened. In fact, I would be surprised if ONE person bought an Arctic Cat as a result of Sarah wearing the jcket.
These ethics complaints are simply laughable. The problem of course, is that all the compaliners need is one of these lunatic complaints to stick for them to really smear Sarah (as if they haven't already). I wonder what they'll complainers will do next year when Sarah wins reelection with 60-65% of the vote. Every time a complaint is tossed I'll bet it adds .5% to her re-election margin.
