The Associated Press Editorializes and Equivocates About the Palin Ethics Complaints



The Associated Press’ Rachel D’Oro strikes again with a supposedly objective article full of editorializing, moral equivocation, and half truths:

Alaska Gov. Sarah Palin says her political enemies are abusing state law with a flurry of frivolous ethics complaints against her, putting her more than $500,000 in legal debt.

Those filing the grievances - there have been at least 18 cases so far - say it’s their legal right to hold the Republican governor accountable for what they see as abuses of power.

The truth is probably somewhere in between.

In between? How is 14 dismissals and one settlement of the 15 cases that have been decided “somewhere in between”? This game of hedging the obvious conclusion is how non-objective journalists pretend to be objective. D’Oro doesn’t want to admit that Palin was vindicated so she writes that “the truth is probably somewhere in between.”

The truth is quite clear. This wasn't an instance of “she was acquitted on a technicality, but we still don’t know who the killer is, so maybe she did do it.” The facts were investigated by the Personnel Board and the law was clear -- she did nothing wrong. Even the one case that was settled stated that she violated nothing in the Ethics Act and committed no “wrongdoing.”*

D’Oro goes out of her way to quote one of the ankle-biters with a case still pending:

“She said she was going to be open, transparent and wanted people to hold her accountable,” said Kim Chatman, an Eagle River resident whose complaint against Palin is among the few still pending. “I took her for her word.”

“Holding her accountable” does not mean making a mockery of the Executive Branch Ethics Act by filing complaints against her for such transgressions as wearing a jacket, conducting a television interview in her office, and giving a speech at a charitable event out of state.

Chatman’s complaint alleges Palin is misusing the governor’s office for personal gain by securing unwarranted benefits and receiving improper gifts through the Alaska Fund Trust, which was established by supporters in April to help Palin pay her legal bills.

Chatman’s ridiculous complaint will be tossed out like the others. The Alaska Fund Trust operates under the strictest limitations I’ve ever seen for a legal defense fund. Read the AFT's website FAQs. The contributions to the AFT “can only be used for legal expenses incurred by counsel on behalf of the Governor, her family, and staff.” It’s as straightforward as that.

When Chatman’s complaint is tossed out can we expect a long write up about it by Rachel D’Oro?

D’Oro provides an editorialized and factually inaccurate summary of Troopergate:

Elected in 2006, Palin enjoyed an unprecedented 18-month honeymoon with Alaska residents and lawmakers alike until last July, when she fired Walt Monegan, the state’s popular public safety commissioner.

Monegan believed he was terminated over his refusal to let go a state trooper who was involved in a contentious divorce with Palin’s sister. Palin cited budgetary disagreements.

The “popular public safety commissioner” Walt Monegan got only 8.69% of the vote last April when he ran for mayor of Anchorage. That’s not exactly fan club worthy. D’Oro was editorializing about Monegan’s supposed popularity. That’s a no-no for reporters who have pretensions to objectivity. (Though I suppose you could say that Monegan was “popular” with union boss John Cyr and the Public Safety union for whom he served as useful idiot.)

She also misstates the facts. Monegan was not fired or “terminated.” He was simply re-assigned. He chose to quit. And Monegan believed at first that his termination had to do with his lack of communication with the governor. That’s what he told his colleagues in his farewell email to them. It wasn’t until he spoke with Palin-hater and gubernatorial loser Andrew Halcro that Monegan dreamed up his allegation that the real reason why he was re-assigned was because he wouldn’t fire Trooper Mike Wooten. Keep in mind that Monegan has always stated for the record that no one ever asked him to fire Wooten. But he later claimed that he felt “pressure.”

He must not have felt too much “pressure” because he didn’t even know what Mike Wooten looked like. Ann Coulter noted in her book “Guilty”:

In the midst of the Palin family’s formal complaints about state trooper and former Palin brother-in-law Mike Wooten for threatening her family, drinking on the job, and Tasering Palin’s nephew, the public safety commission asked the governor to sign a photo of a state trooper, in uniform, saluting the flag for the purpose of turning the photo into a poster. The trooper chosen for this photo was none other than...Mike Wooten!

You’d think that Monegan would at least know what the guy looks like if he felt so pressured to fire him.

D’Oro continues:

State lawmakers investigated, ultimately concluding the governor broke an ethics law that prohibits public officials from using their office for personal gain, although the firing itself was considered lawful since Monegan was an at-will employee.

Days after being named McCain’s running mate, Palin said the legislative probe had become too political and filed a “self disclosure” with the Alaska Personnel Board, whose three members are appointed by the governor. The day before the presidential election, that investigation concluded that Palin violated no ethics laws.

Notice how she details the Branchflower Report’s flawed conclusion, but she doesn’t note that the Petumenos Report for the Personnel Board, which is the entity charged with enforcing and interpreting the Ethics Act, stated that the Branchflower Report’s interpretation of the Act was flawed and therefore its conclusions were incorrect. Not only that, but the Petumenos Report accurately identified the Branchflower Report for what it was – “the findings of one attorney who was not subject to an adversarial proceeding in which his findings could be tested,” and yet Branchflower’s findings were mistakenly treated as if they had weight. They didn’t. But unfortunately they are still treated as if they do – even now after the Personnel Board has made its ruling. (Also, keep in mind that the Personnel Board had access to more evidence than Branchflower.)

The conclusion reached by the Personnel Board was non-partisan, even though the investigator, Petumenos, is a known Democrat and was writing his report during a contentious election cycle.

D’Oro writes that the three members of the Personnel Board “are appointed by the governor.” Notice how she writes “are” and not “were.” She is being careful. She wants to convey the impression that the bi-partisan Personnel Board is somehow in Gov. Palin’s pocket, but she can't outright lie and claim that the current members “were” appointed by Gov. Palin because they weren’t.

The board’s current members were all appointed by Gov. Murkowski (and you know how friendly Sarah Palin was with the Murkowski administration). One of the members originally appointed by Murkowski was reappointed by Gov. Palin. This is not a board “hand-picked” by Sarah Palin. They do not work for Sarah Palin.

Please note that the Personnel Board is a volunteer board. By law they can not be state employees. And by law they must be bi-partisan. They receive no salary. The governor can only dismiss them for “cause.”

The board is independent in every sense of the word. And the real power is with the independent investigators. The governor has no control over the investigators at all. The Personnel Board hires them, not the governor. The decisions the investigators return are based on the law, not partisan politics.

Once again, the key fact here is that Gov. Palin has been vindicated in 14 out of 14 ethics complaints by a bi-partisan independent board whose mission it is to enforce and interpret the Ethics Act. Those are the facts.

D’Oro notes:

Alaska law mandates that ethics grievances remain confidential unless a public accusation is filed or the accused person agrees in writing to make it public. However, most complainants have ignored this requirement and have publicly discussed their grievances without any legal consequences.

“Why is confidentiality so important? So the process does not become a forum for partisan attacks, headline seekers and disgruntled wing-nuts,” Palin attorney Thomas Van Flein said in an e-mail. “This is exactly the type of political gamesmanship the confidentiality clause was intended to prevent.”

Chatman said she spoke with an attorney and learned she wouldn’t breach confidentiality if she talked about her grievance before filing it in late April. She said she did just that, based on a lack of trust in the Palin administration.

“I thought it would be swept under the carpet if the public didn’t know about it,” she said.

So, let me get this straight... Chatman publicized her complaint but that wasn’t breaching confidentiality? What, pray tell, would be breaching confidentiality? How does Ms. Chatman and her attorney define breaching confidentiality?

According to the Executive Branch Ethics Act (AS 39.52.340):

(a) Except as provided in AS 39.52.335 , before the initiation of formal proceedings under AS 39.52.350 , the complaint and all other documents and information regarding an investigation conducted under this chapter or obtained by the attorney general during the investigation are confidential and not subject to inspection by the public.

I’m not a lawyer, but it sounds like Chatman breached confidentiality to me.

D’Oro gives Chatman the final word in her claim that she’s not “breaching confidentiality,” but she doesn’t seem to think that Gov. Palin has any right to publicly be upset by these endless politically motivated attacks, which have cost her over $500,000 in personal legal debt.

D’Oro finds a willing mouthpiece for her own opinion:

Palin was wrong to publicly criticize the complaints before the appropriate government body - the personnel board in most cases - had a chance to analyze them, said Gregg Erickson, a Juneau economist and longtime watcher of Alaska politics. That’s simply bad politics, he said.

“She rises to the bait fairly quickly when they troll these things by her,” he said. “I think it’s a weakness.”

Who is Gregg Erickson? In a Washington Post chat session on August 29, right after Palin was named to the GOP ticket, Erickson was described as “Columnist and Reporter, Anchorage Daily News and Editor at Large, Alaska Budget Report.” So D’Oro interviewed a fellow journalist to get his opinion on Gov. Palin. Sound like good reporting to you? Basically, D’Oro used Erickson as her mouthpiece in order to get across her opinion.

D’Oro does mention, without mentioning, our Webathon:

Even some of Palin’s critics question the validity of some of the complaints, and her supporters have waged a weeklong Webathon to raise money for a legal defense fund set up for the governor, ringing up more than $109,000 by day seven, Sunday.

Gee, nice of you to provide our website address. For the record, D’Oro never contacted us to get a statement about the Webathon, but she was quick to contact Chatman. Fair and objective reporting? Yeah, right.



*By deciding to settle the case concerning her children’s travel, Gov. Palin decided to hold herself to a higher standard than her predecessors. The Personnel Board investigator readily admitted that the regulations for family travel were vague, and the governor was simply following established precedent. The settlement clearly stated:

Nothing in this agreement constitutes an admission of wrongdoing, and none has been found, nor may any inference of wrongdoing be inferred by virtue of the execution of this agreement in any other proceeding.

I am a HUGE fan of Governor Palin. Right now she is the ONLY reason I have the slightest interest in politics. PERIOD.

However - I am getting REAL tired of the never-ending articles, blogs, and comments about the 'ethics' complaints.

I'll state, as I have many times: There is an untold story hidden in this mess. For a Governor as powerful as she is in the State of Alaska - one of the most powerful governors of all 50 - there simply has to be an inside reason why this crap is still going on.

WHY ARE THE PEOPLE OF ALASKA ALLOWING THIS?

I'm more than sure that every day the good folks up there put stops to injustices of MUCH LESS importance than this one.

I'm not interested in hearing the excuses as to why some think it can't be stopped.

IT CAN BE STOPPED. IT'S JUST NOT BEING STOPPED FOR SOME, UNKNOWN REASON!

Just another glaring example of why the MSM continues to loose credibility as a reliable source of news and information in the eyes of average Americans.

The more they continue to behave in such a obvious partisan manner the more damage they do to their credibility and the smaller their audience will get.

So keep up the good work Ms D’Oro im sure that someone with your extensive qualifications will have no trouble getting a position in the food service industry once the AP is forced to downsize as a result of the loss of circulation caused by the partisan hackery of its editors and reporting staff.

I would be the first to admit that I am clueless. Maybe you can fill me in so I will understand.

Why would a blog want to spend approx. $6,000 to obtain e-mails of a sitting Governor and her staff members, radio station, etc. if they even exist. Lets take a example of an e-mail between staff or the radio station.

Gov. Palin sent an e-mail to the radio station and/or staff and said, "I would like to come on and discuss the complaints against me and I am hoping there will be a backlash against these people filing the complaints. The prior complaints have been dismissed and this is costing the citizens of Ak. thousands of dollars."

Now, Diva files an ethics complaint about this or something similar...is this correct??

First of all who cares? Most of the people in Ak. are probably too busy with their own life to give a flying you know what. Another percentage like Gov. Palin and see nothing wrong with it. The remaining people are the ankle biters and what have they proven.
They didn't like her and they still won't like her with or without spending $6,000.

Do they win over support? I don't think so. Do they look pettyy costing the state money that could be used on schools, heating the homes of the cold people they were concerned about last year. Yes.

Now...yes I am clueless...please explain if I am wrong.

DDOJ - Due to the fact that you know the law so well on Per Diem, why are you not complaining about Beth Kertulla getting Per Diem while Legislation is in session? When you make that complaint then you would have some merit.
Also, you may want to check the laws on Per Diem. If you would quit listening to the talking points that David Axelrod gave the Palin Haters in Alaska then you would know there was nothing wrong with her receiving them. In fact if she spends over half her time this year in Juneau guess what. Her Per Diem at home is Tax free. As it was they played the safer route with the IRS and agreed to pay/ Travel rules are all in the Federal Tax Law. Stop listening to Keith Olberman and start researching the actual regs and you would stay ignorant your entire life.

She didn't know that the per diems were taxable income. No one did until the NY Times published her tax returns and they were scoured over by tax experts the nation over to find anything -- ANYTHING -- to criticize.

She had her taxes done at H&R Block. Do you really think H&R Block was cleverly trying to create a tax loophole for her?

juju - THe Governor paid her taxes based on the form and info she had. SHe did a correction immediately (unlike Tax Xheat Timmy who waited until a political appointment). Travel Regs are complicated at best with FED tax law.

Knock off this nickel and dime stuff about Sarah's 17 grand, as if she's absconding with a mountain of tax money on 17 thousand measly dollars. That wouldn't pay the bar tab for the Rainmakers at Holland & Knight when they treat the Florida Legislature to their skybox at the Swamp during the Florida/Florida State game.

If the good people of the great State of Alaska want their chickensh*t 1,800 dollars (or whatever the taxes are on the per diem), it will be adjudicated by the court and Sarah will pay it. There's no scandal-just the pretense of one by idiot clydes who should know better. But it's the waste of the voters' time with this MOUNTAIN OF HORSECRAP that amuses the hell ouf of me.

These people filing these ethics charges are a boatload of chickensh*ts. They'd get laughed out of politics down here. All they are doing is trying to ruin some woman's career over amounts of money that would embarass a Miami street hooker, and you act as if it's IMPORTANT? And they act as if it has meaning? It's nothing but small, petty, vindictive, mean little b.s..

You want to know how petty this is?

-Tiger Woods gives that kind of money out for tips when he's home in Orlando.

-They pay that kind of money to the guys in costume at Disney World-as severance pay.

-That's how much money is usually found on corpses in the Miami River, and then only if the Corpse has a Familiar Face.

-If you offered 17 grand to a cocaine dealer, he would slit your throat, then kill you for having insulted him in front of his friends with such a petty amount of cash.

-That is about the amount of money you need to buy a set of Titlest clubs, with woods, irons, and travel bag.

-If you offer that amount of money to any trial attorney in South Florida, he will handle your small amount of money for a tiny fee. However, when you want it back, you may have to contact his friend in Nigeria.

-The interest on 17 grand may be enough to bury your cat.

-You cannot get into the Daytona International Speedway for the Daytona 500 on Race Day with the interest money from 17 grand.

People in Alaska who file spurious ethics violations against Sarah Palin are the same kind of people who think that it was a good idea for the guy in the Barney the Dinosaur costume to threaten to go on strike: there are many paths to enlightenment, but there is only one sure-fire way to stupid.

There are Venezuelan exiles who wipe their a**es with that kind of money, and use the rest to plot the overthrow of Chavez. Who the heck do these people think they are kidding? "Connect the dots...", as if they're doing something important. If I were an Alaskan, I would be insulted by this level of stupidity masquerading as self-righteousness. And what's more, the Governor herself will never be hurt-it's a waste of the Alaskan taxpayer dollars.

Think of it this way: these people are like those rubes who go down to Seminole Indian Gaming and think they are going to walk away from the House with Hundred Grand from the Texas Hold'em table. Only in our example, Sarah Palin is the House, and the ethics complainants are the rubes.

Except the taxpayers of the State of Alaska are paying the bill everytime these Clydes go to the Poker Table and Cash Out, 'cause Sarah would rather not be the Dealer. This is not a game she ever wanted to play.

What rotten timing for Palin to be in office. She has to spend much of her time at home in Wasilla because the plumbing at the Governor's Mansion is not up to snuff. I don't blame her for spending that much time away from Juneau. Better being at home paying per diem than spending it in a hotel in Juneau on the taxpayers dime.

Wow, she did her taxes at H&R Block? Those places can't be trusted. They're people who take crash courses and then file taxes for people. I heard they make a lot of mistakes and they don't know much. (This is just what I have heard though. I'm working the Accounting field and do my own taxes - basic stuff.)

I hope she finds real accountants to do her taxes next time.

I would bet anything that Diva is contributing at least $500 to the fund to raise the $6,000. That way if she doesn't get enough money she can always withdraw her own $500. You notice there wasn't any max. amount a person could contribute like the $150.00 max. on our fund raiser. If we could have contributed any amount we would have meet the goal.

To raise over $1,000 the first day with little to no national support seems really unlikely unless someone was a donor of at least $500. It will be interesting to watch. Gov. Palin maybe running for her second term before the get the $6,000.

Ummm... You seem to be upset that Governor Palin (and the entire Alaskan executive branch) had some trouble interpreting a ridiculously complex tax code. Where was your concern when half of your Dear Leader's cabinet couldn't interpret the tax code, including the guy who is in charge of the IRS, Treasury Secretary Tim Geithner.

Oh, and DDJ, you never answered my question from before. You claimed you are a libertarian after arguing for protectionsim on the pipeline. I will ask again, how is protectionsim consistent with being a libertarian? As a libertarian, do you want the government to tell you, for example, what brand of ripple you can drink in your doublewide? Or for that matter, should the government tell you where you can purchase your doublewide and from whom?

I was just hoping President Obama would be open and transparent but after the car buyouts, the firing of an IG, and the rush to get healthcare "reform" (20% of GDP costing Trillions) done by the fall has basically thrown that idea off the table.

A few minutes ago I ran across this article (which I had never seen before) published for some odd reason in this weekend's San Francisco newspaper. It is about Governor Palin's Evansville speech in April and is written by the AP's Ken Kusmer.

Perhaps the spiteful, chip-on-her-shoulder Rachel D'Orio should pay attention. Someone in the Associated Press CAN still write a straightforward, accurate news story:

EVANSVILLE, IND. — Alaska Gov. Sarah Palin, speaking at an anti-abortion group's dinner, criticized President Barack Obama for supporting abortion rights and challenged the idea that unplanned pregnancies are a nuisance that can be solved by abortion.

Palin, the 2008 Republican vice presidential candidate, spoke to an overflow crowd organizers said numbered 3,000 at the Vanderburgh County Right to Life banquet Thursday night.

Some in the crowd wore white "Palin 2012" T-shirts. Earlier, GOP National Chairman Michael Steele described her as one of the party's standard bearers, though he said it was too early to judge what her standing would be in three years.

Palin said the challenges she faced during her pregnancy with her son Trig, who was born with Down syndrome, gave her an opportunity to live out her anti-abortion beliefs. She said she prayed often during her pregnancy, especially after tests revealed that her son would be born with the condition.

"The moment he was born, I knew that moment my prayers had been answered," Palin said. "Trig is a miracle. He is the best thing that ever happened to me and I want other women to have that opportunity."

She challenged the notion that children must be born perfect and that unplanned pregnancies are inconvenient and can be ended by abortion. "I know for sure my son is perfect just as he is, made in the image of God," she said.

She asked the crowd to keep working for the "culture of life" in America.

"Life is ordained, life is precious," she said.

Palin said women who can't give birth should have the opportunity to adopt children who might otherwise be aborted. She mentioned that her own daughter Bristol became pregnant as an unmarried teen and has since given birth to a son.

Palin also took Obama to task for his support of abortion rights and embryonic stem-cell research.

She said deciding when babies get human rights isn't above her pay grade — a reference to Obama's response to a question from the Rev. Rick Warren last year. The Democrat said such questions were above his pay grade.

Palin received at least two standing ovations. After the speech, she addressed an overflow crowd in another room and thanked them for their support.

During a news conference earlier, Steele said Palin is among a crowd of GOP standard bearers that includes fellow governors Tim Pawlenty of Minnesota and Mark Sanford of South Carolina.

He also cited other prominent party figures, including former Massachusetts Gov. Mitt Romney, ex-New York Mayor Rudy Giuliani and two congressmen, Eric Cantor and Mike Pence.

"We have a significant number of men and women in our party who are in a very good position right now to carry forward the standard of the GOP," Steele said.

Pence represents Indiana and Cantor is from Virginia. Many Republicans also look to Louisiana Gov. Bobby Jindal as a presidential favorite in 2012.

Palin hasn't ruled out a White House bid. Steele said it was too early to gauge what her standing would be in 2012.

Palin was cheered wildly as she entered the banquet hall with her husband, Todd. She stopped to sign autographs before taking her seat.

Palin, her husband and Trig also had been expected to attend a breakfast Friday morning with S.M.I.L.E., a nonprofit support organization for people with family members who have Down syndrome. Trig turns 1 on Saturday.

But Palin said Trig, who had the sniffles, stayed home with his grandmother.

Some Alaska lawmakers criticized Palin's decision to make the trip as the state Legislature approaches its Sunday deadline.

It must really be a slow news day...they are just repeating old news...someone said that they wondered when the people of Alaska would say enough is enough or stand up for the governor...I would like to tell him/her I feel this is happening...maybe not as loud as we would like...but it is there...listen to the callers on the RB show...

I may not be from Alaska but I will STAND UP FOR GOv. Palin and no one is going to tell me to sit down...and I want to Thank all the ones who research and post the truth...thank you for not only posting the truth but the links so that we can read all the information...so with you all I will help fight the good fight..God Bless you all

I still use AOL, but avoid the news page...It's as left as it gets, and most of their "writers" are lefties. Trust me, when Exxon and TransCanada reached their agreement, AOL didn't have two words to say about it. They're only interested in the tabloid-type stories, and praising Obama.

Reading this AP story COULD make me tired. Tired of the trashing. Tired. Tired. Tired. ALL the media (CNN,MSNBC,CBS,ABC,NBC & yes FOX) pounces on the trash stories for ratings. The AP writes stories that get picked up by other papers big & small that distribute it to the masses. It COULD all feel so futile. It COUL make me want to lay down my club and battleaxe and sleep.

Than I meet someone today in a waiting room of a tire store. We are both getting new tires on our cars. He noticed the "Don't blame me I voted for McCain-Palin" bumper sticker on my car.

He says "your a Palin fan aren't you?" to which I reply "You betcha."

He askes me what I see in this woman. I tell him. He starts spouting the lib talking points about Palin's wardrobe, her brother in law, the ethics complaints..etc. I can tell the other people in the room are paying attention, their magazines dipping down as they look our way.

I cut down every one of his cheap efforts to discredit Palin with facts that I learn from C4P. I am curteous but brutal in my facts. The final straw was his defense of Letterman. I went right to the point:

"So you defend comics who make jokes about the statutory rape of 14 year old girls?"

"No..I...uhmm...thats not..."

"So a mother cannot take her 14 year old daughter to a baseball game without some jerk on TV making a joke about a 3rd baseman taking her daughter down to the dugout and raping her?... In America?"

"......that was just off color humor."

A lady chimes in sitting by the vending machines..."David Letterman was wrong to do that. I don't think it was right. Gov. Palin had every right to demand an apology. Somebody has to stand up for whats right."

The guy behind the stool at the counter says... "If that was my daughter, David Letterman would be missing that bucktoothed smile of his."

The Lib is getting uncomfortable and returns to reading the People magazine he had in his lap.

This is what recharges my batteries. This is what sustains me. This is why these AP stories that should make me tired, and weary simply ooze off the armor like the slime it is. C4P has given me the armor,the weapons & the pride in knowing that we fight for Sarah every day, for what is right. If I can change a few minds a couple of times a week, for 4 years...it adds up and spreads. Hopefully I've armored afew new barbarians found in a tire store.

For what it is worth, there were more than 14 ethics complaints dismissed against Palin - some of the complaints consisted of more than one imagined offense.

For example, one of McLeod's complaints had 6 or 8 supposed violations including her assertion that since Levi lived at the Palins' home, any money he made should have been reported as income by Sarah. Yes, I am serious.

I think that the words "deliberate lies" are perfectly servicable.

Funny, but you'll accept an IRS boss as Treasury Secretary who evaded taxes, under the guidance of Turbo Tax whle he was working at the World Bank, which punishes
whole countries for some official's
tax evasions, state legislatorswho ignored law and historicalpractice,
who let a respected public servant to ultimately deprive the state of representation to score apolitical point. The AD News is going out of business, because in part it is selling out it's supposed method of truth telling. Jenkins clearly shows just from recent events how clueless he is just on the TC/

Nothing is wrong with holding anyone accountable for their promises. The problem is that you are holding her accountable for a tax problem that wasn't her fault, and according to the IRS she did everything RIGHT. Her EMPLOYER made a mistake, not her, and according to the IRS she filed her taxes appropriately.

Clearly you have a vendetta against her. "Open and Transparent" does not mean you should be privy to everything, by the way. What else do you want to know? How often she goes to the bathroom? Damn.

My suggestion to you: Lighten up. Life is short, go enjoy. Stop being such a dick. You will make more friends that way.
