Statement from Gov. Palin's Legal Counsel on Defamatory Allegations
The following statement was issued by Gov. Palin's legal counsel, Thomas Van Flein:

On July 3rd, 2009, Governor Sarah Palin announced her intent to resign her gubernatorial duties and transfer the powers of Governor to Lt. Governor Sean Parnell.
Almost immediately afterwards, several unscrupulous people have asserted false and defamatory allegations that the “real” reasons for Governor Palin’s resignation stem from an alleged criminal investigation pertaining to the construction of the Wasilla Sports Complex. This canard was first floated by Democrat operatives in September 2008 during the national campaign and followed up by sympathetic Democratic writers.1. It was easily rebutted then as one of many fabrications about Sarah Palin. Just as power abhors a vacuum, modern journalism apparently abhors any type of due diligence and fact checking before scurrilous allegations are repeated as fact.
The history of the Wasilla Sports Complex is publicly known. Contrary to the insinuation that as Mayor of Wasilla, Sarah Palin “personally” oversaw bidding, construction, funding and accounting for the project (and thus, the allegation goes, “embezzled” from the project), the truth is far more mundane, and publicly available:
Curtis D. Menard was instrumental in spearheading the effort from conception to realization of the Wasilla Sports Complex. He directed the steering committee that was responsible for placing the issue before the voters of Wasilla and subsequently passed. He remained chairman of that committee through the design and construction of the facility. He was an ardent supporter and leader of civic, educational and athletic endeavors within the community as well as an advocate of the continued success of the Sports Center.

As Mayor, Governor Palin did appoint the committee, another fact readily verifiable, and she was publicly on record supporting the need for such a facility—as was most of Wasilla. “Wasilla weighs sports facility” published December 6, 2001 and available at http://www.adn.com/sarah-palin/background/story/517370.html. While her public support of this project was deemed pivotal by many, the actual construction, bidding, financing and other day-to-day management of the project was not in her scope of authority as Mayor.
In addition, Sarah Palin was then criticized by some of not showing enough interest in the project. The Frontiersman reported that at a public meeting with the Chamber of Commerce, an opponent of the project “accused Wasilla Mayor Sarah Palin of staying quiet about the arena because of her campaign for Lieutenant Governor.” “Sports Arena Campaign gets Rolling” http://www.frontiersman.com/articles/2002/02/21/news6.txt (February 22, 2002).
Further, this was a highly public project, approved by the voters, and subject to public bid requirements. As described by the City of Wasilla itself:
The city uses competitive means for the purchase of all goods and services as required by Wasilla Municipal Code 5.08. The city also utilizes contracts and price agreements established by the State of Alaska, the Western States Contracting Alliance and other cooperatives or agencies when it is deemed to be in the best interest of the City. The city believes in open, fair competition and strives to ensure that all vendors have equal opportunity to compete for city business.
The City of Wasilla operates under a decentralized purchasing system. This means purchasing decision up to $5,000 is made independently by the departments in the city (with the exception of Management Information System purchases). When the estimated amount for goods or services is between $5,000 and $9,999, departments are required to obtain three quotes prior to purchase. The departments may utilize the services of the Purchasing/Contracting Officer (PCO) for this process or may do it themselves; however, when this processed is selected, the PCO must sign off on the final product prior to purchasing or contracting.
For purchases beyond $10,000, the city requires all departments to contact the PCO who will utilize the city's bid process according to Wasilla Municipal Code 5.08. The bid process is initiated through either an Invitation to Bid (ITB), utilized when the city knows the specifications for the purchase; or a Request for Proposal (RFP), utilized when the exact specifications or process is unknown.

Accordingly, the Sports Complex was publicly bid, in accordance with City and state law, and was accounted for in the time and manner all public projects are handled. The Mayor of Wasilla, be it Sarah Palin, or her successor, did not handle the funds, or the materials, for this project. To thus suggest she “embezzled” is as false as it is impossible.
The additional claim of “proof” of wrongdoing is the allegation that the Palins purchased building materials from Spenard Builders Supply—and that this company may have provided supplies for the Sports Complex. Prior to the construction of Lowe’s and Home Depot within the last few years in Wasilla, Spenard Builders Supply was the primary building supply company in Wasilla. It can hardly come as a surprise that it would sell materials to small homeowners or that it would also bid to supply commercial contracts. One would be hard pressed to find a home, cabin or outbuilding in the Mat-Su Valley in which Spenard Builders Supply did not sell at least some of the materials.
The Palins built their Lake Lucille house using Todd as the general contractor. Todd’s family owns a hardware and building supply business in Dillingham. He is no stranger to construction, or to rolling up his sleeves and doing work. The Palins used a combination of personal savings, equity from the sale of their prior home, and conventional bank financing to build the house—like millions of American families. The deeds of trust are recordable public records. Basic journalism and fact checking would confirm this.
The Sports Complex was built in 2002. It is now 2009. While the Federal Government has a process to follow, and that process sometimes takes time, we can categorically state that we are not aware of any “federal investigation” that has been “pending” for the last seven years. We are aware of no subpoenas on SBS regarding the Palins. We are aware that the Federal Department of Justice and Federal Bureau of Investigation have been helpful, responsive and diligent in prosecuting the email hacker and in cleaning up Alaska’s corrupt legislators. To be blunt—this “story” was alleged during the campaign, evaluated then by national media and deemed meritless. Nothing has changed.
To the extent several websites, most notably liberal Alaska blogger Shannyn Moore, are now claiming as “fact” that Governor Palin resigned because she is “under federal investigation” for embezzlement or other criminal wrongdoing, we will be exploring legal options this week to address such defamation. This is to provide notice to Ms. Moore, and those who re-publish the defamation, such as Huffington Post, MSNBC, the New York Times and The Washington Post, that the Palins will not allow them to propagate defamatory material without answering to this in a court of law. The Alaska Constitution protects the right of free speech, while simultaneously holding those “responsible for the abuse of that right.” Alaska Constitution Art. These falsehoods abuse the right to free speech; continuing to publish these falsehoods of criminal activity is reckless, done without any regard for the truth, and is actionable.

Apparently that is uncommon in New York. Our Secretary of State , Karen Handel, who is running for governor in a big primary fight was in attendance. I had a chance to speak with her for a couple moments and I told her that one of the reasons I like the SOS so much is "she doesn't take crap from nobody. Just like Sarah Palin".
She smiled and thanked me.
The buzz was all over about Sarah's announcement and we had a 30 minute period called rapid fire where guests could ask the host questions and a questioner asked about Sarah and everybody was real focused on what the speaker had to say.

I have watched in wonder as every "reporter" on various networks interviews every imaginable person to try to figure out exactly why Gov. Palin resigned. It is abundantly clear by their questioning that the media personalities have never owned a business or attained a position with more responsibility than daily wardrobe choices, or the answer would be obvious. When someone of good character and conscience assumes leadership "command and control" of any organization, a good leader will place the needs and interests of those led/served above their own.
For those who still don't understand, let me explain. Gov. Palin is not running from the personal assaults against herself and her family, although who could really blame her if she did try to shield her children from the filth and evil in the minds of some of her most fervent attackers. She has chosen to remove herself from a situation that has become both costly and unproductive for the government and people of Alaska.
In the face of unrelenting ethics attacks that wasted the time, money, and talents of the citizens of Alaska that Gov. Palin had sworn to faithfully serve, she finally said "enough" in order to end the waste, fraud, and abuse perpetrated against the people of Alaska. It appears that Gov. Palin made careful arrangements to provide a smooth if not seemless transfer of power to the Lt. Gov. at the end of July, and this was not a hasty personal retreat.
Bottom line, Gov. Palin saw the damage that the personal attacks against her were doing to the people and government of Alaska through her, and chose to fall on the grenade to save the people and state that she loves so dearly.
In my line of work, we call these HEROES.
Palin only needs to do this on these attacks regarding her being unethical or a criminal. not personal attacks.
She will have to take those.

Well I guess Van Flein answered that question. She definitely should look into legal action against all of them.

The other good thing about Sarah stepping down is she will probably now be allowed to raise the yearly contribution limit on the Alaska Fund Trust since she is no longer a State Public Office holder. I believe Don Young and Ted Stevens have much higher limits on their funds of $1,000 or more.
I don't think Sarah will go that high, but if she increases the limit from $150 to say $500 per year she will have her legal debt paid off in no time, with money to spare to go on the offensive against these people.

With respect to the rumor-mill that was desperately trying to churn out the extortion lies, I carefully watched twitter to see who said what, then doubled back doing some research of my own trying to locate the origins of the stories.
Then I conducted a WHOIS search on a powerful tool I use which found the main websites linked together to one main site are all inter-related... and a lawyer/former lobbyist is the Registered Admin for the site. She is extremely highly connected - to a powerful lobbying legal firm - and the who's who throughout Washington, New York, Chicago and beyond. I checked into her facebook connections AND her trail of contacts/connections through the mapping tools at muckety. It blew me away.
I nexted checked into the Technical Admin. No surprise to find that he is an SEO Streaming Email teckie geek - a real master, knows his stuff extremely well. What did surprise me is his ownership in a solar company specializing in solar power.
Many of the sites connected thru that one website you will recognize. They've been mentioned in comments here (plus there are more).
Some of the names connected to their web through the lobby legal firm will blow your mind. It will shock you how high the connection goes... and how deep.
I've not mentioned names here because I don't know who to trust with this information. It's out there, if someone has the patience to dig deep and far enough.
This is more than a machine -- it is a monster of massive proportions. My hope is that Sarah will succeed in bringing it down.

Van Flein just dared the New York Times to send their best bloodhounds after this story. Why tempt fate if there's a there there (as Gertrude Stein said of Oakland). Sometimes bloggers believe their own propaganda about a person, and it leads them down places where they shouldn't go.
You don't do this if there is even a hint of criminality involved on the part of your client. This is a smart political move on the part of Palin.

I live in suburban Cincinnati, Ohio, a traditionally republican area of a swing state- and deeply patriotic. I went to a local fireworks show this evening and was surprised to see that, despite the cool temperatures and the persistent drizzle, there were hundreds of people there waiting for an Independence Day celebration. As I drove home and entered my neighborhood, the streets were lined with families laughing, kids with sparklers, and the sound of firecrackers in the distance creating a constant low rumble.
And then I started thinking about Sarah. And the timing of her announcement- on the eve of our celebration of independence. This is what she's fighting for. This is what we are all fighting for. The freedom to progress and to succeed for ourselves, for our families, for our children and their children. Sarah understands that freedom and democracy are fought for. I think over the last 24 hours she's given us indication that she's in for the fight. She just wasn't willing to fight on the Alaskan tax payers dime. Nor was she fully able to engage in the fight.
I wonder how we will view these past 48 hours when we look back years from now. I wonder if her timing should give us some indication of her mission. She said earlier this month, "politically, if I die, I die". This clearly has gone beyond politics for her and has become about principle. I stand behind her principles and I stand behind her. I'm holding on tight because I know this is gonna be a great ride!

Yep. In fact I think the "iceberg" in general and this indictment rumor in specific have gone beyond propaganda and passed into fantasy for these people. It is actually quite sick.
Should be interesting, it would appear the good old days of just floating a rumor about her out there and letting it pass into myth may be over.

I got online tonight to see if there was any more news from Sarah. I ran into this nasty story on a link to Daily Kos. This was the first I had heard of it. As I read it, I was hoping she would sue. Then, I found this letter from her attorney. Way to go! Sarah is a force. That is why they are all afraid of her. As I watched her speech yesterday, I was amazed by her speech. She is a great statesman that will be proven shortly. I expect to see great things from her in the near future and beyond. Reporting from Washington -- A day after Alaska Gov. Sarah Palin resigned, a federal official in her home state dismissed one potential explanation for her sudden and unexpected resignation -- a rumored FBI investigation into the former Wasilla mayor on public corruption charges.
Despite rumors of a looming controversy after Palin's surprise announcement Friday that she will leave office this month, some of them published in the blogosphere, the FBI's Alaska spokesman said the bureau had no investigation into Palin for her activities as governor, as mayor or in any other capacity.
"There is absolutely no truth to those rumors, that we're investigating her or getting ready to indict her," Special Agent Eric Gonzalez said in a phone interview Saturday. "It's just not true."
Gonzalez added that there was "no wiggle room" in his comments that could exclude any kind of probe.
The FBI has been active in mounting public corruption probes in Alaska, some of them to see whether local, state and federal lawmakers illegally received favors, money or even free construction work from Alaskan businesses and people who wanted favors from them.
The most high-profile case was against former Republican Sen. Ted Stevens, whose conviction last year on charges of lying on Senate ethics forms stemmed from charges that he got illegal work done on his house by a politically connected developer.
The Obama administration Justice Department threw out the charges in April, saying prosecutors had failed to turn over potentially helpful information to Stevens' defense team. Some bloggers have speculated on the Internet in recent days that such an FBI investigation was underway on Palin, who still had 18 months in her term.
Also Saturday, the former GOP vice presidential nominee posted a statement on her Facebook page, not offering specifics but indicating that she had broad goals after she leaves the governor's office.
Palin did not say whether she planned to run for president in 2012, but criticized media coverage of her announcement:
"How sad that Washington and the media will never understand; it's about country. And though it's honorable for countless others to leave their positions for a higher calling and without finishing a term, of course we know by now, for some reason a different standard applies for the decisions I make."

Gov. Sarah Palin's resignation is a great political move for her & our country. Once they thought about it, the majority of Alaskans are actually proud of Sarah Palin for taking first steps towards 2012. This was an appropriate day (Independence Day eve); for her to take some time with her family, focus on immediate strengthening of state and national objectives; all without having her hands tied by holding political office. If Congress and the Obama Team can announce things like the "Cap & Trade Energy Bill" on a Friday; as they have done many other major sneak through bills; then why can't our Governor let the local media know her news first and on a Friday? She also wasn't taking up state time to do it; as she did it on a national holiday and wasn't at work, so no ethics violation. The mainstream media is going crazy with this, like a pack of dogs chasing their tails. Keep on surprising them Sarah.
Our nation is finally waking up to the realities of the Nov. 08 election results and now we want our country back. Sarah is not a quitter, but instead a fighter who thinks outside of the box. She is the square peg that won’t be forced into the round hole; a “complex conservative” (coin termed by my spouse) that both political parties and the media can’t figure out; which is what scares them so much. She may be living outside of the continental United States now; but will end up taking the country by storm come 2012 and move to our country’s capitol.

Palin gave an excellent speech on Friday (without Speechwriters or Teleprompters); showing intelligence, good eye contact, speaking honestly and directly from her heart straight to the heart of the average American and didn’t require any hand holding (as she writes her own stuff). On the other hand, Obama pays his 28 year old speech writer $175,000.00 (one of the top paid people in Washington) and doesn’t normally do any speeches without a Teleprompter and his personal speechwriter. Think about it. Who is actually the better speaker, based on “their own merit”? Sarah is head of the pack without a doubt.
The mainstream media needs to report ALL statistics correctly and not falsely quote or intentionally misconstrue facts. The "Mainstream American" is beginning to see through the smoke and will now hold their feet to the fire; which is fixing to get really hot. All ethics charges were filed after her nomination for VP candidate and were pushed by the mainstream media’s attack on her and her family. The 15 false ethics charges (cases she has won) have been dropped. By stepping down, she will prevent millions more of state money spent in her defense and wasted time spent by state employees on defending more charges. Not one of them was proven valid, but continues to cost the Palins thousands from their personal budget.
Sarah is the opposite of Obama in so many ways; budget conscious, a supporter of capitalism, honest, supports our constitution, ethical, patriotic, believing in and not wanting to control her country and more. This is the opposite of Obama and multiple other governors & senators who have left their gubernatorial or congressional responsibilities gathering dust, continued drawing a paycheck from the government coffers, and traveling while in the process of running for higher political office. She can now spend days or weeks away from the state and will not do this on the public dime. What an unusual political candidate; a real, honest, hard-working, ethical, middle-class person; not wanting to waste her state’s money. WOW.

Great post. You really nailed it. Especially your opinion on Governor Palin being a superior orator compared to the chosen one. Sure Obama sounds eloquent when speaking and usually speaks in complete sentences and knows how to finish a thought. But he can't hold a candle to our Sarah. She is simply mesmerizing as a speaker. I've been trained in public speaking, yet when I see/hear her speak I am just astonished. Clearly she makes a long lasting impression on most everyone who hears her speak. Truly she is is a league of her own. Praise the Lord as she is a gift for all real Americans. (and she cares about the jobs, has to be all about the jobs).

I couldn't believe it when I read the comments in my email this morning. You spent the entire night on a pro Sarah site. And we're supposed to believe you're not afraid of her?
I am a Democrat. After Sarah's announcement, I read my favorite websites, and then searched out Fox Nation (a first for me) and yours. I'm not normally on these blog sites. What is striking me most is how very personal the attacks are on people who don't agree with you. (I guess in a way that is a personal attack on you, sorry.) I'm really trying to find the best Sarah supporter arguments because I just don't see her as Presidential material. Even if she were extremely capable, she seems like she would be so polarizing to your party.
I'm also wondering about the quotes of facts I read here. Were millions literally spent on her ethics charges? Anchorage Daily News tallied up the cost at $296,000, with the bulk of that stemming from the Troopergate investigation of last summer. Sarah says she's spent $600,000. Neither number is "millions".
The ethics complaints were mostly dismissed but she was found by the AK legislature to have abused her power and violated the state Ethics Act with Troopergate. She had to payback money for clothing from the RNC and she recently paid money to the state for her children's travel expenses. These aren't huge in my mind, based on what she was accused of, but she is not innocent of all charges as I've read here.
Then her poll numbers, yes she had an approval rating among Alaskans of around 89%, but by May of this year it is more like 55%. Still a majority, but not the 90% I see written here and on Fox Nation.
Then, if you want to talk facts about Obama's legacy, you have to admit, Bush set the stage for a tough presidency to follow. His enlargement of the Administration through setting up the largest expansion of the Federal Government since FDR. His two wars account for much of that pricetag, and Obama inherited that situation. Here is a quote I found online, October 2008/Washington Post, Bush Administration's last month:
"The White House does not contest the numbers showing near-record growth in the size of government on its watch, but says it has no regrets about the president's decision to eschew a limited government agenda in favor of homeland security and defense spending. "
Many Republicans did and still do approve of the very expensive wars that Bush set up. He deserves the credit for that. Obama inherited a financial disaster. I am just as worried about the spending to dig us out of this mess, but Bush's choices are his legacy, give him credit for that.
Palin’s move puts yet more pressure on Obama to finally get some results, as the soaring rhetoric isn’t hypnotizing the plebes like it used to. This week Helen Thomas, Colin Powell, and Warren Buffet all turned on him. Polls are looking droopy for The One lately.
Obama’s porkulus program is a train wreck, all it’s done is bump interest rates and tank the dollar. We are being laughed at by bad guys like Tehran, Pyongyang, and Al Qaida who amazingly turned-down Barack’s friend-requests.
Palin could trounce him in 2012, when Americans would vote for the Gipper-in-Heels in droves- while begging for lower taxes, free enterpise, a defense posture with some backbone… an end to the radical, anti-American nightmare we’ve got now.

The Palins owe it to the country to sue their pants off. Their attorneys need to uncover the networks of money and influence that are destroying political discourse in this country, and honorable people, like Sarah and Todd, who are trying to serve.
Go Get em! The public need to know the truth about how these nasty people work. And the only way that's going to happen is if they get sued for their lies.
