Feinstein's Bill Will Make Hunting in Alaska Extinct
A couple of days ago, we posted an article about an attempt by United States Senator Dianne Feinstein of California, along with co-sponsor Benjamin Cardin of Maryland, to limit predator control. (It seems that Senator Whitehouse of Rhode Island has also signed on as a co-sponsor.)
When we spotted this, we tipped every reporter and media outlet in Alaska we could think of...and nobody thought it worthy of notice except for Eddie Burke and Alaska Public Radio.
I was listening to the Alaska Public Radio bit - here is what they had to say:
For those of you unable to listen (or without the patience), here is what I picked up -- Deputy Commissioner for the Alaska Department of Fish and Game, Patrick Valkenburg, said that the proposal would "make it impossible" for Alaska to manage game populations.
This intrigued me; previously I thought that the bill merely prevented the state from issuing permits to citizens to assist in predator control, and instead required state employees to do the wolf culling. So I went digging for the text of Feinstein's legislation. It wasn't easy - the text has not yet been posted by Congress in the normal places.
So I went digging in the Congressional Record and found it...it begins on the bottom of page S8274 and continues through pages S8275 and S8276.
And I found that the bill language contains some bombshells that weren't spelled out in Feinstein's press release. Feinstein would like people to believe that the bill merely stops citizens from hunting wolves under permit from the state.
However, an examination of the bill language proves otherwise. Check this out (emphasis added):
(3) ENHANCING THE PROPAGATION AND SURVIVAL OF WILDLIFE.
—No person exempted under paragraph (1) may shoot, attempt to shoot, or harass any wolf, bear, or wolverine for the purpose of enhancing the propagation and survival of wildlife, including game populations, unless—
(A) the head of the fish and wildlife agency of the State and, for game populations on land under the jurisdiction of the Department of the Interior, the Secretary of the Interior, or for game populations on land under the jurisdiction of the Department of Agriculture, the Secretary of Agriculture, determines, based on the best scientific data available, that—
(i) a biological emergency is imminent;
and...
Wait - what's a "biological emergency"? The definition is provided:
BIOLOGICAL EMERGENCY.—The term ‘biological emergency’ means the likely extirpation or a significant and imminent threat to the sustainability of a wildlife population due to predation by wolves, bears, or wolverines, or any combination of those animals.
OK, got it. Let's continue...
(ii) all other practicable means to prevent the biological emergency, including stopping regulated takes of the declining population, have been implemented; blah blah blah.
So, here's the deal. Nobody can even consider culling of these predators unless there is a "biological emergency". A "biological emergency" only exists when the prey population (i.e. moose or caribou) is in danger of going extinct ("extirpation"). And even if that condition is met, the state must first end all human hunting ("regulated takes") of these food animals.
This is in direct contravention to the current policy of the State of Alaska:
Harvesting wild game is extremely important to many Alaskan families. Participating in the hunt and sharing the bounty of economical, wild-grown meat are long-standing traditions.
Feinstein wants to take away the right of rural and Native Alaskans to subsist on herds of moose and caribou in favor of wolves. I don't know what the substitute is supposed to be - perhaps government welfare.
The Alaska constitution calls for managing Alaska's natural resources (which includes wild game) for abundance and for the benefit of the people:
§ 1. Statement of Policy
It is the policy of the State to encourage the settlement of its land and the development of its resources by making them available for maximum use consistent with the public interest.
§ 2. General Authority
The legislature shall provide for the utilization, development, and conservation of all natural resources belonging to the State, including land and waters, for the maximum benefit of its people.
§ 3. Common Use
Wherever occurring in their natural state, fish, wildlife, and waters are reserved to the people for common use.
§ 4. Sustained Yield
Fish, forests, wildlife, grasslands, and all other replenishable resources belonging to the State shall be utilized, developed, and maintained on the sustained yield principle, subject to preferences among beneficial uses.
This bill interferes with Alaska's ability to maintain it's wildlife for "sustained yield."
The bill is currently in front of the U.S. Senate Committee on Environment and Public Works.
Alaskans need to get in touch with Governor Parnell and their state legislators on this. (I notified all 60 of Alaska's state legislators with our original story, and I'll notify them again with this one.) They also need to get in touch with Congressman Young, Senator Murkowski, and particularly with Democratic Senator Mark Begich, who is a member of the Senate Democratic Majority.
It'll be interesting to see what Begich's position on this will be. Back in 2005, an animal rights group targeted Alaska because of the state's predator control system, and Begich didn't take their side:
A national television figure who expressed a desire to visit Alaska has become the target of dueling invitations - one to come enjoy the hospitality of the Far North, one to boycott until the state stops killing wolves and bears.
The host of "Today," Katie Couric said on air Tuesday that she'd love to visit Alaska to catch a salmon.
Anchorage Mayor Mark Begich responded by issuing an official invitation and a seafood company donated two smoked Cook Inlet sockeye fillets to whet her desire.
But a Connecticut-based animal rights group has asked Couric to stay away.
Friends of Animals faxed a letter to Couric on Wednesday, urging her to join a national tourism boycott over the state's predator control programs and hunting policies, said Susan Russell, the group's information officer.
He didn't seem to mind predator control back then. I wonder what his position will be now? Will he side with his party or with his state?
The Anchorage Daily News reported at the time:
Begich, ever the diplomat, said that all sides of the controversy are welcome in Anchorage, including staffers from Friends of Animals.
“I appreciate their views from Connecticut, but we have a great city here,” he said. “If they want to come up, I’ll get them out king salmon fishing too.”
It's awfully hard to play diplomat this time. Do you support the Alaska state constitution? Do you support hunting in Alaska? Or do you support the anti-hunting whims of Senators from California, Maryland, and Rhode Island?

Just read some parts of the bill - I think this applies to aerial hunting and "land and shoot" hunting only.
I think basic land hunting is ok, so villagers and sport hunters can hunt w/ a permit as they please.
I'm sure that if there was another method, Alaska would've used it already, but since I'm thinking predator controllers are trying to chase a pack of wolves, it would be easier and safer to find and kill them from air, then to go on ground to hunt one by one.
I guess we'll see what Sen. Murkowski has to say. Her father as governor supported aerial hunting as well.
As for the whole 'wait until animals are near extinction' part of the bill - that's just crazy. More wolves would be wandering Alaska streets like the caribou and moose.
Why are these senators proposing a bill for something that has nothing to do with their state? Geeze, mind your business and stop trying to have the federal government control EVERYTHING. And considering Cardin is one of my senators, I don't understand why he doesn't focus on the many issues in Maryland, his own state? He wasn't elected by Marylanders to concern himself with issues regarding Alaska...leave that to the ALASKAN senators.

FYI, I still don't know anyone that has ever admitted to have voted for her. I honestly don't understand how these senators always land in their chairs without even running campaigns.
That said, just know I am working my fingers to nubs to get it though her thick skull that this is unacceptable. I'm of native decent and I am enlisting the help of others to stop this in it's tracks....This is an assault on the Constitution and the people of Alaska.

And yes it WOULD impact hunting in general because the goal is to keep the moose and caribou populations stable. This is impossible with more wolves, right? And the only option would be to limit human hunting.

If Levi really wants to cut his losses and be an actor or whatever, I don't really care. But if he's going to get serious about just making something out of himself he should do it on his own power and quit climbing over the Palins. The media doesn't care about him anyway, they're just using him. That's the tragedy of the whole thing. The Palins did not victimize him. The media was stupid towards him in the beginning, but all we saw of him was the convention. After that I don't think the Palins even mentioned him until Bristol's Greta interview, and that was in a positive light. Levi is playing right into the hands of the people that called him white trash in the first place. He's just lookin' out for himself now. And I loved the parts about "just get out there and tell the truth..." Riiiiight. Like when his sister told Star Magazine that Bristol wasn't going to school and wouldn't graduate. Uh-huh. Very credible people. Levi and Bristol have different value systems. That doesn't really matter when you're 16 and dating in high school, but when you're raising a kid and on the brink of tying the knot, all of a sudden that stuff does matter. And I think the media pressure plus the sudden emergence of the real differences between them was what broke them up. I mean, it's okay if Sadie wants to drink and party when you're just dating her brother; it's another story when you're trusting her and her drug-dealing mother to watch your child. I don't know, that's just my speculation. Based on personal experience, I might add. My Dad's family and my Mom don't really get along. Why? Different values and priorities. And, of course, each thinks the other is wrong.

Won't this bill also effect the other Western States that have predator control. I would think something like this would be a 10 amendment issue. In other words tell the feds to stuff it.
Any NRA members out there? Anyone with a connection to Field and Stream? How about Ted Nugent? This is something that pro-hunting groups, and the NRA would be interested in. Once of essentially ban hunting, there is no need for all those pesky guns.

I think a better idea would be to start applying some Alinskyite tactics to Senator Feinstein. I understand she presents a target-rich ethics environment all by herself.
The fact that Congress gets to police itself does become a problem.Crime sometimes is punished but ethics are out the window. The only control is elections and identifying and eliminating them at the source is the only way.No aerial hunting allowed!
This bill is a clear violation of the 10th amendment. If it passes and "the ONE" signs it, It would never clear the first legal challenge. But realistically it should never hit the senate floor, it is just plain bad legislation.
I am not an expert on this, but wouldn't this bill conflict with the Endangered Species Act or similar? It would be forcing some species to be nearly extinct as I read the post.

CA bloggers should file legitimate ethics complaints about Feinstein, and issue a press release and/or hold a press conference on each one. Same with the MD Senator where appropriate.

Alaska just passed a bill telling the government that Alaska WILL follow the the Constitution and WILL NOT allow any federal law to interfere with the states powers. OK, I am back from town and have read the comments. I have to agree with the comments that state "an ETHICS complaint should be filed against Feinstein" for not doing California business. It is no business of hers what Alaska does and she is wasting both State of California and Federal monies going in the the direction she has chosen. I am going to go read the ethics laws of California to see if an out-of-stater can file a complaint.

One of my dear, sweet 90 year old patients in my medical practice was telling me that she knew Sen Feinstein's father-in-law in Walla Walla, WA, 60 years ago. It was so unusual for a Jewish person to live in that part of the country in those days. She said everyone loved him.
Now I never talk about religion, about politics, or about how much pills cost, so she knows nothing about me.
But then she said that she could not believe his son married that idiot. I have laughed about dear Mary's comment two two weeks.
There is nothing that I could say that would add to her short and sweet assessment of the good senator.

Um i think all that bill stated was that they are going to limit the number of wolf cullings so as to not artificially inflate the number of prey at the expense of the wolves.
There not trying to end hunting. What is says is that rather than kill wolves off to avoid the extinction of an animal they would first stop the regulated takes which is standard practice for any endangered species. After all, if you extinct a species you cant hunt it anymore at all. But if you show some restraint you and your kids and their kids will all be able to hunt.
All that stuff only happens if the population of prey were to be going extinct which would naturally decrease the population of wolves, etc., cause theres less food for them naturally letting more prey animals live. The bill is simply letting nature run its course. Dont let the media distort it all out of proportion as to what it actually is.

I do not think we fully appreciate what Gov. Palin did for the people of Alaska when she stepped aside.
Has anyone stopped to think what would have happened to Alaska had she remained in office? The Obama / DNC thugocracy could not have taken her down without significantly harming the Alaskan people. This latest Feinstein outrage is just one example. Who doubts that the next target would have been the Alaskan oil and gas industry, or the fishing industry, or the tourism industry?
She could have withstood the ethics complaints. She could have withstood the media. She could have handled the yahoos in the legislature. But, she could not have withstood the destruction of the Alaskan economy.
By making herself the target, she has tried to spare the Alaskan people the whirlwind of the radical left. She would only have been hurt politically. She would have survived financially. Not so the thousands of innocent Alaskans who would have lost their livelihoods.
Never entrust power to anyone who is not willing to surrender it.

Sen. Feinstein, think of what you are proposing.
If your view of hunting was imposed on Alaskans, you would in essence be telling Alaskans, "... in Alaska you DON'T hunt, therefore the wolves eat."

The problem with the bill is that it attempts to usurp AK's jurisdiction. AK has a state constitution, along with state agencies, and one of them is the Gaming Commission, the body duly charged with the regulation of AK's wildlife, which includes predator control.
Congress has three purposes in writing law: protection of rights, remediation of past errors or grievances, and laws which set forth proper procedures so that the law is equally applied.
This bill appears unconstitutional and a flagrant violation of states' rights, and shows a complete lack of empathy with Alaskans and their real need for predator control.
Congress does not have the authority or the expertise to involve itself so invasively into AK's affairs.
These and like-minded sentiments, if presented to our senators, may sway them from siding with Feinstein & company.
The reason I'm saying the bill is unconstitutional is this: The duties of Congress: write law, raise revenue, regulate interstate commerce, and raise an army and declare war.
Let's tick those off:
Write law. There are three types of law: protective (of people's rights), remedial, and procedural law. The bill does not fall under this ambit. [There is administrative law, but adminstrative law is written by adminstrative agencies]
Raise revenue through taxation. The bill does not fall under this ambit.
Regulate interstate commerce. The bill does not fall under this ambit.
Raise an army and declare war. The bill does not fall under this ambit.
Hence it is unconstitutional.
This move by Feinstein, et al, is infuriating. I hope Governor Parnell holds the line on this. The Constitutional implications greatly transcend the other issues here. Wolves or no wolves, caribou or no caribou, I hope Alaskans step up to the plate here and defend their right to self-determination on these issues. Alaskans, we're counting on you. Fight them.....please.
And as a Kentuckian, I'd like to personally apologize for Ashley Judd. She speaks of her love for Kentucky but we have a lot of subsistence hunters here in Kentucky, too, and Judd knows it. She's betrayed her fellow Kentuckians on this issue, at least those who hunt for food.

What gall Feinstein has to ignore the very common-sense ruling of the Alaska Supreme Court which considered all of these issues and made the decision. Truly, Feinstein's action here infuriates me.

Vadm, I agree wholeheartedly. Just one thing: I'm of the opinion that they will continue to target Alaska whenever, wherever, and however they can. Alaskans, it seems to me, are much like Texans (and others, but I'm a Texas so I'll speak to what I know) in that we love our states fiercely - to the point it would be excruciating to choose country over state. The Governor, I believe, loves her state in this way. Liberals recognize and are repulsed by fierce state patriotism. It reduces their ability to consolidate power within the federal government. How do you punish an intensely patriotic Alaskan and American? Why, violate the Constitution while imposing undue and harsh Washingtonian policies on Alaska, of course! This is just the first in, what I believe will be, a long line of attacks on the State of Alaska.
I further anticipate that they'll begin to actively target other states to undermine state authority and destabilize state policy and government. Look out, all of our states are targets.
Just what does CA, MD, and RI know about Alaskan predator control? If I were a voter in one of those 3 states, I would be angered that they were spending my tax dollars that pay their salaries to concern themselves with someone else's state. Alaskans and only Alaskans need to speak regarding predator contol... not busy-body-know-it-all-elitest Senators from outside the state. Here's to you, Alaska!!!

I wonder if bills like that could have any standing? Isn't it an infringement on a state's rights? in other words, can Fed. Government - in case the bill passes - dictate to a state (any state) how to maintain a(ny) state's own nature and resources? And as such, wouldn't it be an infringement of the 10th amendment? Or may be the latter does not specify such an activity?
In any case, it is very strange that reps/senators from different states concern themselves with activity that none of their business, and dictate other state how to conduct its own bussines!.
This has absolutely NO CHANCE of passing; Fienstien (Like Ashley Judd before her) is just getting her Fienstein/Palin forced association in "print". NRA and every hunter in Alaska would camp on Fienstyein's doorstep with a loaded rifle if the bill EVER comes close to becoming law. Imagining it somehow did, then only outlaws would eat unprocessed meat.

The place must have erupted when Sarah entered the room. The article said that the event culiminated with her visit. The attendees must have been flabbergasted.

So, while the MSM was making up news about her and her "divorce" to fill the void of Sarah news, she was at a convention being honored by and speaking to the NRA.
I guess we need to pay attention to upcoming conventions, etc coming up in Alaska. It should have been anticipated that the NRA would ask Sarah to speak. They didn't advertise her at all and she responded by showing up.

The beauty of AK is that she is somewhat protected up there. The local media doesn't stalk her and the paparazzi aren't up there to follow her every move. She certainly knows how to keep her moves quiet though.
AND Good for the NRA for being able to keep this quiet for her! I'm assuming that they would have announced this if she had let them.
