Obama Effectively Walks Away From Meaningful Tort Reform
In an interview with Steve Croft this evening, Obama said the following about tort reform:
KROFT: If it came down to getting this plan passed, would you be willing to do more in the area of tort reform and malpractice insurance? Would you be willing to agree to caps, for example, on malpractice judgments?
PRESIDENT OBAMA: What I would be willing to do is to consider any ideas out there that would actually work in terms of reducing costs, improving the quality of patient care. So far the evidence I've seen is that caps will not do that.
Obama missed the evidence cited by Governor Palin in a recent Facebook note:
Many states, including my own state of Alaska, have enacted caps on lawsuit awards against health care providers. Texas enacted caps and found that one county’s medical malpractice claims dropped 41 percent, and another study found a “55 percent decline” after reform measures were passed....Limiting lawyer contingency fees, as is done under the Federal Tort Claims Act, is another step. The State of Alaska pioneered the “loser pays” rule in the United States, which deters frivolous civil law suits by making the loser partially pay the winner’s legal bills. Preventing quack doctors from giving “expert” testimony in court against real doctors is another reform. Texas Gov. Rick Perry noted that, after his state enacted tort reform measures, the number of doctors applying to practice medicine in Texas “skyrocketed by 57 percent” and that the tort reforms “brought critical specialties to underserved areas.” These are real reforms that actually improve access to health care....Dr. Weinstein’s research shows that around $200 billion per year could be saved with legal reform.
As is usually the case with his interviews, Obama has given Republicans and conservatives a gift. This statement shows that his loyalty lies with trial lawyers and comes just days after Obama claimed in his address to a joint session of Congress that he'd be open to inserting meaningful tort reform measures into a prospective healthcare bill. Howard Dean already let the cat out of the bag at a recent townhall when he admitted that "[t]he reason that tort reform is not in the bill is because the people who wrote it did not want to take on the trial lawyers in addition to everybody else they were taking on."
Polling indicates that a plurality of Americans support the idea advocated by Governor Palin and other conservatives and currently opposed by Obama and most of the Democrat Party. Republicans and conservatives should take a stand in support of honest doctors and make it clear that that there "can be no true healthcare reform without legal reform."
This interview also revealed that Obama remains angry that the idea of "death panels" has been introduced into the debate:
The notion that we've got death panels that would pull the plug on grandma. As I said before, that's a simple lie.
Correct me if I'm wrong but hasn't Obama now explicitly used the phrase "death panels" more than Governor Palin? Nearly half the country believes Obama is lying. Perhaps this strategy of calling political adversaries liars without addressing their arguments is a strategy that should be placed on its death panel.
Update: The most recent Washington Post/ABC News poll finds that "placing new limits on medical malpractice lawsuits finds significant public backing: Nearly two-thirds support caps on the amount of money that can be collected as a result of medical errors, with support increasing since June." We'll talk more about this poll tomorrow as some of the data is devastating for Obamacare when considering that the sample is comprised of 21% Republicans and 24% liberals.

This is not surprising at all. Obama was clearly lying Wednesday night. Not just on this issue but on just about everything he said. Joe Wilson, if impolite, was absolutely correct. Obama is owned by the unions and plaintiff's bar and will never do anything to upset them.
I would love to see Governor Palin come out with a Facebook statement calling Obma out on this lie. If she did, the media would have trouble keeping it quiet.

The more Obama denies the death panels, the more people will see he's lying.

I remember seeing a graphic recently about how much money the Democrats get from ambulance chasers. That would explain the eschewing of tort reform.
Obama's idea of tort(e) reform is modifying a dessert recipe.
This is a tough issue, as no one wants to deny and/or trivialize truly worthy person/lawsuit.
I myself believe that individuals should be entitled to torts ( lawsuits ) and that if they win them that a very very loose cap should be in place.
The one thing that pisses me off about malpractice suits is the "class action" type.
I don't know about you, but I have been a "prize-winner" in one of those, where I get a letter saying I get $2.18 as long as I send in a letter to claim it. Then in the fine print I read that the law firm got 22 million.
I an 54 years old and have gotten 2 "official letters" saying that I was part of a class that "won" something and about 4 letters telling me to be aware that I might "win" something.
The huge payday for me /sarc is dwarfed in magnitude by the attorney that somehow finds some "class" and then somehow sues something/someone in it's behalf.
A lot of times YOU are involved in a class action suit and you do not even know it, because this is the way that the golden egg comes to trial attorneys.
The class action category of lawsuits is the real villain in our Tort system and IT needs cleaned up very very badly.
I am fairly certain that at least one political party has tried to ban class action suits and that the supreme court upheld their existence.
Any new law should read that if an attorney/law firm sues on behalf of a class and it is found negligent, then that attorney or law firm pays all the bills, not any defendants or insurance companies.
I say leave individual suits mostly alone and clean up the class action type.
The Class Action aspect is the most heinous disregard for actual individuals and the most LUCRATIVE for trial attorneys.
This class of suits is what needs cleaned up, and not so much individual suits.

Palin can continue to work on enlarging her Facebook network. Can she build an audience that is larger than CNN, PMSDNC, CBS? What will it take to discredit the SRM?
The conservative blogosphere appears to be gaining a foothold. The Tea Parties show American's care for the founding fathers' principles. Fox hasn't been sucked into the SRM yet. Joe Wilson may be the canary in the beltway. He may also help show the Republicans the way to 2010 victory.

Squalid performance by Teh Won last night. They say that familiarity breeds contempt. The man doesn't get that he's been on TV too much and that people are getting tired of having his mug in their faces.

Wow! I mean, this bespeaks a disciplined candidate with a tight inner circle that has learned not to leak and backbite. That speaks real well of her. Also something else: no more missed appointments and people saying that Sarah is going to turn up At Our Event.
Something Really Good is Happening In SarahLand. She is turning into a professional operation.
And she has gone to ground until she is damn good and ready to come out and fight on her terms, which means she will have maximum media exposure when she does.
I should add that Romney is doing the same thing, but Sarah is going to have a lot more grassroots impact. The contest between Romney and Palin is much like the contest between Bush and Reagan in 1980. It will have the same result, too.

Although there are too many lawyers in this society, their influence is measured in $ donations to the democrats, not in votes and public opinion. The vast majority of the country does and will continue to support tort reform, particularly in the context of healthcare.
Keep pounding away on it. It's a winning issue, and it's also right.
Obama and the congressional democrats need to be called out and cornered on this one.

I suspect two additional things are going on. One-the discipline imposed by the Washington Speaker's Bureau and the possible presence of someone recommended by Fred Malek. The influence of Fred Thompson could be out there as well. It just looks like a much more professional, polished operation.

Playing games with Sarah's team and making her prove something when it was her teams word vs the other siede is one thing. When a neutral party is calling them out and reminding them she is under contract with them so they better cut the crap out puts a sudden halt to all of this. Think about it, some organization reports Sarah is speaking. WSB calls and and asks "who the fu@# are you" and tells them Sarah is contracted with WSB so better remove her name immediately. Sarah doesn't have to be the bad person, Sarah is not involved. WSB pim# slaps the twerps and Sarah gets to stay above the fray.
Oh "if" Sarah runs I do believe Jerri and Fred Thompson are the ones to get to run her campaign. I know, I know Fred ran a terrible campaign but at the same time it was clear his heart wasn't in it. If Sarah enters the fray she will be "all in". Fred and Jerri are otside the beltway "Inside the Beltwayers".
I liked Fred, for one thing his monologues on "Law & Order" was the closest thing to a conservative viewpoint to emerge
on that piece of agitprop. He was a tough law and order reformer, (sound familiar) Who didn't like him Cameron of Fox News and Politico, they all practically genuflected for Romney, how'd that turn out.
WSB is taking care of things. Having a pro org like that represent you is money well spent.
Sarah will not regret one penny sent to them. They will keep people from playing games using her name.
She is their star and they will have her at the top of the kick butt list to protect her name.

Tort Reform and Obama will never mix.. like oil and water.. POTUS is the oil, Lawyers the water, just floating- as Madame referred to a "dead fish"... "JUST GOING WITH THE FLOW", Lawyers supporting and taking that Dead Fish where ever they want.
Im with you guys on the WSB... Madame will be taken very good care of... they posses the Golden Egg.. so to speak!

Im definitely liking that name the more I hear It... know Sarah is one of us, we consider her a friend and all, don't think she minds us referring to her by her first name buy Madame has that elevation I like... not elitists in any way.. but overflowing with Respect, Honor, Trust and Virtue.
All... 'Madame-like traits'... deserving of Madame 45!
